Hi!

My husband is a US Citizen and I have a green card.We were planning to have the delivery in India,after carefully deciding the care the baby would get in India vs here.

Can my baby still be a US citizen as her father is one?

also ,please advice if you think giving birth in US would be better than India.

Baby is due in feb,when it's going to be too cold.

That's up to you, if you are having a complicated pregnancy and think India has a better hospital system and will take better care of baby and you then go.

The only problem I see is getting baby's BC with father's name on it, will hubby be there?. Also when you all come back and you become a USC you can petition your baby's citizenship. Or if father is there he can register baby at US embassy.

Our Timeline:

11/1999 - We met in Ecuador

02/05/00 - Relationship started

09/08/06 - Engaged & Pregnant!

03/13/08 - I filed for Citizenship

07/22/08 - Became US Citizen

08/02/08 - I-129F sent

08/13/08 - Case received by VSC

08/16/08 - NOA1

08/18/08 - Touched

12/18/08 - Touched again exactly 4 mos. after 1st touch!

12/18/08 - Noa2 @ 3PM-Gracias Dios Mio!

12/24/08 - NVC sent pckg. 3 to Embassy

01/02/09 - Pckg 3 rcvd. by Embassy

01/09/09 - Pckg 3 from Embassy received by beneficiary

02/09/09 - Medical exam

02/16/09 - Sent back checklist and docs required by embassy.

03/13/09 - We will fly to see Daddy Gary

03/16/09 - 1 PM Interview (Pray God he gets visa)

03/16/09 - 5PM INTERVIEW PASSED WOOHOO. Thank God.

03/25/09 - Visa on hand! he went to DHL office after phone call received.

04/18/09 - My Cuchi came, (NYC)a wonderful unbelievable moment!:)

04/20/09 - We applied for marriage licence. (Township Municipal Bldg Health Dept.)

04/23/09 - Licence on hand

04/29/09 - Applied for Social Security (He was in system!)

04/30/09 - Wedding day!!! Yeeebaa

05/07/09 - SS card in mail. "valid for work only with DHS authorization"

05/13/09 - Sent AOS paperwork.

06/16/09 - Biometrics Apptmt.

06/25/09 - EAD Card in mail!

06/26/09 - Letter saying case transfered to Cali.

08/08/09 - Residence Card in Mail! Yuuupiiiiiii.

THE END FOR 2 MORE YEARS.

I don´t need patience if I have love. Ah I que Viva mi Guayaquil Carajo!

Father must have lived in the US for at least 5 years with two being after age 14. Does not matter if he was a USC or LPR during that time. If he meets the requirements, then your child is automatically a USC. File a CRBA at the local US embassy/consulate and get your child a US passport.

Father must have lived in the US for at least 5 years with two being after age 14. Does not matter if he was a USC or LPR during that time. If he meets the requirements, then your child is automatically a USC. File a CRBA at the local US embassy/consulate and get your child a US passport.

My Husband has been living in US for 11 years and just last year-2008 he turned into a US Citizen..so he does qualify for making his baby a US citizen when in India through a US embassy ...is that right.

Your USC husband will need to file the CBRA with the closest US consulate as stated.

As to whether or not to have the baby in India, that will be up to you and your wants. I've seen some of the boutique-type labor/delivery hospitals in Delhi and would not think twice about having a baby here. Add to that the proximity of family; I can see why it may be very tempting.

Keep in mind a variety of things though - will you be comfortable flying with an infant back to the US, establishing a relationship with a pediatrician months before delivery, getting everything ready for the baby in the US ahead of time...Just think thru the steps involved and see if it works for you!

Yes he does qualify to apply his kid a US citizen in India through US embassy you won't get any problem.
