my fiancee and i lived together while he was here in cebu philippines for work!

and when he was laid off with his job he had to go home and find another job while we are processing the k1 fiancee visa

but unfortunately no matter how hard he was hunting jobs there wasnt anything for him just yet!

and he's doing a part time with his mom now and not getting paid much

and also he wasn't paying taxes last year cause he was in phil the whole year working and he's still not paying now cause he's not hired yet

so my questions are

1. with him not paying taxes last year, what do you think we should do? is it a biggy?

2. i heard theres a poverty rate whatsoever! you think my fiancee is gonna be affected? cause he's not getting much?

3. if that, what about a co-sponsor?

any suggestions? i need them please.. thank you ! and have a good day!

1. Him not filing taxes is ok, as long as he was under the threshold of having to file. Just submit a letter from the USC explaining that he was not required to file. If his Philipine income meant he should have filed (the US required you to file tax returns for foreign income even if you don't actually need to pay taxes in the US), he must backfile taxes. A short delay in the process, but not difficult.

2. Yes he will be affected, as he won't be able to sponsor you unless he is starting to make more, or has assets (shares, savings etc) to make up the shortfall in income.

3. A co-sponsor is probably your best option. Maybe his mom? I read on here the US consulate in the Philipines is very picky about co-sponsors, they much prefer if it's a family member.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Right, distance relatives, best friends, friends and strangers should not be co-sponsors. Immediate family (sister/brother/mom/dad) is the best bet.

1. If he was not required to file (not likely if he worked at all) he can simply state the reason why. Not filing is NOT the same as not paying taxes. Most people ARE required to file, 40% of people are exempt from income tax due to deductions, credits, etc. If he did not file, but needs to, he will have to do that. If he does not owe tax there is no penalty for late filing.

2. Yes, he will need to meet the guidelines. $18,212 for he and a fiancee. More if you or him have children. They WILL deny the visa if he does not qualify

3. Co-sponsors in PI are on a case by case basis, they do not like them and usually approve them only if they are a family member fo your fiance. Check in the PI sub forum for answers on this also.
