Just Curious Question, Anyone filed for hardship for not meeting their fiance?

LoL your so right lol I am trying everyway possible to find another way round thats cause ive always managed too...but I guess not with this issue grrrr! but ok wat if we met once lets say for 5 days and yes we still liked eachother and still want to go ahead with the K1 are we still in a 95% chance of getting APPROVED?

CAUse i like read most of ya'll timelines and you guys keep flying out to see eachother 2wice the least lloll how will 5 bloody days sound to them!!!

so guys tell me how bad is the AOS petition what issues will ppl face how much are usually the overall costs *horror music*

Agreed. Marriage brings up a ton more problems and issues than a K-1. All the problems that prevent you from meeting won't be resolved with a K-1 and will in fact get a lot worse.

Right, both from a right-brained and left-brained point of view.

Parental, cultural, and religious mandates might be a reason for an exception to the in-person meeting requirement, but only if both of you intended to follow those mandates during and after your wedding.

You can't have it both ways. If the wedding itself would violate the wishes of your parents and/or your religion's mandates, then by filing for the K-1, you will have said that those authority figures do not hold authority over you. That is of course your decision to make, but if you decide that they hold no authority over you, then you can't use their authority to claim exemption from the in-person meeting requirement.

Either obey them or disobey them; I don't know you well enough to offer guidance on that point, though I can appreciate that you have some difficult decisions. But don't merely obey them when obedience is convenient, and don't use obedience to their rules as an excuse to try and make it easier to get a visa that will allow you to ultimately disobey them.

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

One more thing... If you're seriously interested in the subject and considering pursuing a hardship waiver on the in-person meeting issue, be sure and check out this USCIS Link before filing your petition. It shows the record of a number of final decisions issued by the USCIS regarding K-1 petitions. Theoretically, those cover all kinds of issues, but you'll see that a large number of the K-1 decisions had to do with people who thought they should be eligible for a waiver of the in-person meeting requirement, but the USCIS judged otherwise.

Be sure your case has fact that are significantly different than any of those that they've already denied. If the facts of your case look like one of the published cases that were denied, they will most likely follow precedent and deny yours, as well.

Wow ... I just finished reading through the past couple of years of judgements on that link and the 2004 page. They are very unbending. I can't imagine anyone actually being able to convince them that a hardship exists outside of some very rare religious/customs circumstances ... and even one of those was denied. Finances are not a hardship. Inability to travel by one of the parties is not a hardship unless you can show that every possibility has been explored/documented/dismissed of a possible alternate meeting location.

The only appeals I could see sustained were those that had actually complied with the requirements, but had not previously provided adequate evidence and then complied by providing the evidence of compliance.

Filing the AOS, EAD (document needed for employment), and getting relevant medical services, it cost my husband and I over $600. Another cost of the AOS is that the immigrant cannot work for several months, and usually when they do find work, it isn't in as good a position as they left behind. So, it's just the USC (us citizen) supporting 2 people.

Also, one must submit an affidavit of support proving that the sponsor makes 125% of the poverty line, showing that he can support the petitioner and himself and that she won't have to ask for help from the US government. Unless one is financially stable, or heading towards financial stability, it adds a lot of stress and difficulties to the AOS process.

rose, forget the forms for a moment and think about the practicalities.

Where will you live?

How will you support yourselves financially?

Is your bf ready to not continue his education and be responsible for supporting your for the better part of a year while you get established? How will he do this?

How will you furnish a house/apartment together?

How will you pay for airfare to visit one another?

How will you deal with your parents cutting you off?

How will he deal with his parents potentially cutting him off?

What will you do if things go wrongly in the US and this relationship breaks up?

There is a lot more to marriage than snuggling and watching movies together. I think you are ignoring some very basic facts of life.

The process definitely does nickel-and-dime you to death, and that's even before you consider things like the cost of missing work time to go to doctor's appointments, have pictures taken, apply for a Social Security card.

If your husband didn't have a job that would allow him to take the time off, and be paid for it, you might also be losing anywhere from a few dozen to a few hundred dollars for anything you need to accomplish. I'm very lucky that my job offers paid vacation and sick time. Not everyone is.

Im in the process in thinking how were going to meet for 5 days!!!! Im sorry But I love this man so much but i understand when ppl say ppl might change their minds after their meet which i hope and no wont happen just a thoght...well i think of it like this we talk on the fone alot there only thing missing is his presence and his face well that doesnt bother me....

Please consider very, very carefully what you're doing. I don't mean to sound patronising, but you and your sweetie are both quite young to be considering marriage at all, let alone a marriage at which a good many people will be displeased and a marriage that carries significant financial, emotional, and bureaucratic challenges.

The folks here, including myself, will want you both to be happy and successful with the path you choose. That's why so many people are advising you to slow down, consider the consequences, and MEET this man before you decide to spend the rest of your life together.

If you give yourselves a chance to spend some time together and warm both of your families to the idea that you want to be together, you may gain a better understanding of each other and the family support you WILL want to have at some point. You're both so young. And it's wonderful that you've found someone who makes you so happy.

And if it's real, it will survive some patience, forethought, and care.
