Thanks a lot for the replies. really really appreciate answers as I have been looking for some for the longest time. There are a few things that I am still cloudy on so if anyone has a good background in this and knows a lot about it could you add me to msn or whatever messenger there is so we can have a little conversation regarding it just so I can clear myself up with everything. You can't legally come to America with "Intent" to get married or it's considered fraud. However, if you get married on a whim in good faith and unexpectedly then you can adjust status immediately. You have to have a lot of proof though. It's just a different process.

Just to clarify.

It is perfectly legal to go to the U.S. to get married and indeed with an intent to get married (the two go hand in hand really lol).

What is not ok is to enter the U.S. with intent to reside there with no visa - and not specify that when you enter (and as we all know if you walked up to the person at the POE and said i'm entering to live in the U.S. with no visa - that would be the end of that). Really the whole marriage thing is not the issue - it is an aside.

cjblack - it all depends on what her intent was when she entered the U.S., say for instance she was just coming down to visit you and on the spur of the moment you proposed, she said yes and you got married. Then it would be just fine for her to stay and adjust status.

It's all about intent when you cross the border and not misrepresenting yourself.
