"Unauthorized employment" question on AOS interview?

Hi there!

A classmate asked me a question today and I couldn't answer: Do USCIS ever ask you about "unauthorized employment" during a AOS interview if your case is family-based?

I tried to do a search on the web and on VJ and I couldn't find a satisfactory answer. I figured out that USCIS could ask you about it if they wanted to and also that if you are a immediate relative you won't be denied residency if you have worked illegaly but nothing about the actual question showing up on the AOS interview.

If you have gone from a B, J, F or M visa to family-based residency... please let me know.

Thanks!

My wife was asked who her current employer was which led into the authorized discussion because she said she had worked there since 2007 (she entered the US in 08). The interviewer looked down saw that it was a foreign employer whom she had stayed employed with and moved on to other questions.

It really doesnt matter whether USCIS asks questions about "unauthorized work" or not. What matters is if your friend is willing to tell the truth or not. Also, there is a portion on the I-485 that asks for work related questions. If your friend lies/lied about it, then there is really no sense in knowing if it will be asked during the interview because most probably he/she would lie about it again.

Thanks to everybody for your responses!

Visacheck, I agree completely with your position: Lies are not the way to go under any circumstances. I think, however, that his question was mostly to satisfy his curiosity about the whole process. As far as I'm concerned, I've never heard of anybody being asked about "unauthorized employment" directly on a family-based AOS interview but I might be wrong and I would like to know what the experiences of other people are.

Thanks again!
