want to go back to live in the usa to be with my boyfriend

Timeline

I've been dating my boyfriend for a year, lived and worked there for two years, and now we're doing a long distance relationship. Before my working exchange visa expired we tried everything for me to stay except marriage. We have set a goal for May 2010 to move to an American city together. We had two ideas:

1) He would use his connections to get me a job and the only thing I need to do is apply for a working visa.

-the only problem with that I could get rejected by the immigration. Is that common? I have a friend from Jamaica that got a job in Washington, D.C but was rejected from immigration for a working visa.

2) Get engaged which we want to do. But we don't want to be separated for a long period of time. Is this something that we should be working on already? I am currently visiting him every month and we're thinking that one time I visit we should elope and get married. Is this an easier road than waiting for a job and for immigration to give me a working visa?

The K1 visa sounds like your best option.....

The K1 visa is the least stressful and most legal way to do which you propose (entering with the intent to marry and stay is NOT). Also, for a genuine relationship, it (or a marriage visa) is the path which will be most likely to yield the result you want. There are not currently any quotas for how many K1 visas may be granted as opposed to work visas, and you will be approved if you meet the requirements.

If you start now, May 2010 is within reach.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

Do they reject you for work visas? Certianly! I got rejected from 2 (even with a US company sponsorship) It is becoming more common to reject work visas in this economy - this is certianly not your best option

Go for the K-1.

A work visa is volitile, if you lose your job (and in this economy...what job is safe) you generally have to leave. Then where are you? back exactly where you are now. K-1 is more stable and is on the route to a green card!

While our K-1 visa application was pending, I visited my fiance regularly and stayed with him for extended periods of time.

I returned to Canada for my medical exam and interview. I did, however, have ties to Canada so that when I crossed the border into the U.S., I could show that I intended to return after my "visits".

Since you are visiting evrry month anyway, I would suggest getting married on one of theose visits and filing for a CR-1. You can still visit, when it is approved you can work, travel etc. The K-1 will be a little faster but then you cannot work or travel until after you are married and have an AP and EAD or green card. Better the CR-1 for "not so long distance" realtionships.
