Hi everyone, I was just wanting some opinions on AP. I am getting ready to send in all our my paperwork for AOS on a K1 visa, and I'm trying to decide whether or not I should apply for AP. My husband and I have no plans on leaving the US until the end of next june, which is 9 months away. Hopefully I should have my green card by then, but should I apply for AP for then just incase? Is it possible to apply for AP closer to the time if I still haven't received my green card? Please let me know if you have any opinion on this subject! Thanks, Karen

I would say yes anyways, because it's free! It's just one more form (that's easy) with evidence you are already sending in for AOS anyway so just duplicate it. You never know if you might have to go back for an emergency or whatnot. I'm not sure I plan on using my AP but I know I'll be a lot happier when I get it, just in case something happened to a family member or close friend.

Apply, the cost is included in AOS and what if there is a family emergency back home? You may not have plans to go back, but I'm sure if there was an emergency you'd be happy to have the AP.... It is a simple form to fill out, as well

OK, thanks everyone! Just one more question, when it asks on the form reason for applying for Advance Parole, what should I write? And it also asks for the date you are intending to travel. And do I fill in The supplement form in Part 7? Thanks!

For reason, I just put "in case of family emergency" and dates put "TBA". It doesn't really matter why or when you're going to use AP, they will surely approve it :)

Hi everybody!

I was reading this thread and I have a question related with the same topic (AP).

Ok, I understood you can apply for AP when submitting the AOS.

But after you receive your GC (even for conditional residence) can you go out of the US without an AP?

I'm asking this because my fiancee and I are thinking to go to Japan for our honeymoon, but we don't know which is the best time to go (before or after I receive the GC).

03/04/2010 - Check Cashed!

03/07/2010 - 1st NOA hardcopy letters received on mail.

03/24/2010 - Hardcopy received "Case transferred to CSC"

03/30/2010 - Biometrics taken

05/07/2010 - I-131 approved and received

05/24/2010 - I-765 EAD card received

August 2nd - got divorced. Maria comes back to her country.

So long as you have no overstay then I don't believe it matters either way. If you have any question about inadmissibility (say you enter and marry on the K1, but are late for AOS), then wait for the GC.

Since you still have control over things, I would say go with AP, just make sure you file AOS/AP on time.

Once you receive your GC, AP is void and you would travel with your GC.
