Received NOA2! But fiancée is in America right now

Timeline

So I received the NOA2 today! :dance: :dance: :dance:

This was much much faster than I had ever though would happen. Total time was 3 months!

However Linnéa is in the US right now as she was here on a tourist visa and her plane ticket back is not till Nov 2nd...

Should we change the ticket and have her return immediately so we can start the next process?

Is it possible for someone other than Linnéa, say her mother, to pick up the information from the Embassy?

The NOA2 says it is valid between 9-21-2009 and 1-21-2010, is this the period that is valid for her to go to the embassy and get issued a K3 visa then receive another 90 days to get married on the K3 or is this (1-21-2010) the deadline for us to get married?

12-21-2008 - Linnea returned to Sweden

01-10-2009 - Joined Linnea in Sweden

06-15-2009 - Engaged!

06-22-2009 - Sent K1 Packet

06-29-2009 - Received NOA1

09-21-2009 - Received NOA2

11-06-2009 - Linnea Interviews

11-06-2009 - Received Notice stating we needed a waiver for 212(e) Student Visa

01-05-2010 - Went to Sweden to be with Linnea while we waited and to help with waiver

03-22-2010 - Linnea gets waiver for 212(e)!

05-16-2010 - Linnea enters into the US at Newark

05-22-2010 - Legally Married

07-17-2010 - Wedding in Savannah, GA.... so much fun

1-21-2010 is not the deadline for you to get married. It is the validity date for the petition. Theoretically, your fiancee should apply for her visa at the embassy/consulate by that date. In practice, however, consulates have the authority to extend the petition validity if it's not possible to interview before the expiration date.

You have only completed the first stage of the process. After NOA2, USCIS forwards the petition to the National Visa Center (NVC), which will usually send it onward to the consulate within 2-4 days—though a small percentage of petitions are pulled out for "additional processing" there, which adds weeks to the process. Once NVC is finished with it, only then will it be sent to the consulate, which will then notify your fiancee.

In all likelihood, your fiancee won't need to pick up any information at the embassy. It'll be emailed, snail mailed, or couriered to her (each embassy has its own procedures). Check your embassy's website to find out how they will proceed when they receive the approved petition.

You would do well to review the VJ K-1 Guides and Flowchart to familiarize yourself with the rest of the process.

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

You petitioned for a K1 not a K3. IMHO, she should return and start the process in Sweden to apply for her Visa (packet 3 et al). She'll probably be back before you know it with the K1 Visa in her passport! Congrats

My experience with the Embassy in Sweden was excellent and they are really fast so I'd expect your packet 3 to arrive soon. I got an interview just over a month after my NOA2 so if you want to speed things up, probably your fiance should go back to Sweden sooner than Nov. Also, if you haven't done so yet start collecting police certificate and birth certificate.

My experience with the Embassy in Sweden was excellent and they are really fast so I'd expect your packet 3 to arrive soon. I got an interview just over a month after my NOA2 so if you want to speed things up, probably your fiance should go back to Sweden sooner than Nov. Also, if you haven't done so yet start collecting police certificate and birth certificate.

It probably needs to be done in Sweden by the doctor who is contracted with the consulate.

As to your timing question, when do you want to get married? If you want to get married in the spring, there's no hurry to rush back and get the visa - because you'll spend more time apart so that your 90 day window for marriage is in the right place. Start with your marriage date and work backwards.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

I also think it has to be done in Sweden. But to know for sure, why don't you email the Embassy in Sweden. I emailed them a question and they emailed me an answer right away and I know other Swedes had the same experience. The phone hours don't really work but emailing them works really well.
