Hi everyone I'm a new member.

This is my case:

They stole my wallet so my green card was inside!!! I don't have a copy!!!!! I know that I have to file form I 90 and pay 290$ but also since my green card was about to expire (jan 15, 2010) do I need to first send I90 with the $290.00 and $85 biometric fee or should I file form i90 and at the same time form 751??? one of the requirements is to send a copy of my green card but I don't have any copies!!! am I in trouble?????? I called the uscis costumer service...they couldn't answer my question. So please somebody help me.

Also This week I will start putting together my package so I will post my checklist. But right now what I need to know is what to do?

P.S. I do have a police item report.

P.S. I went to a lawyer and he told me not to report my stolen green card. I don't agree with this since somebody can missused it and get me in trouble. Iwill file form i90.

you don't have a dateline, and because your card is about to expire, I simply assume you have a 2 year GC? If that's the case, you'll have to file the I-751, for which you need to mail in a copy of your card, front and back. Without it, you won't be able to get a 10-year GC. Therefore, you should report the theft and apply for a replacement card. Bummer!

Make an Infopass appointment if you want to talk to someone that can answer your questions. Likely answer will be to get a replacement in order to file the I-751.

Wow terrible timing. Choices are limited -

File form I90 immediately - a few days later you should get a receipt notice. At a minimum you should get a cancelled check from filing and paying

Prepare your 751 package with a copy of the filed I90, I90 receipt notice, cancelled check, and the police report instead of the front/back copies of the green card

Delay filing the 751 as much as possible but no more than 30-45 days

Send the package in a little late but WELL before the due date- either with proof of lost card and receipt notice that you filed for replacement or with the new card which (hopefully) will arrive in time for you to file

Any other choices that you can see here? Not reporting a stolen green card qualifies as "dumb lawyer advice of the month". (Imagining the scene when the green card shows up somewhere in the hand of an illegal or worse and the rightful owner never bothered to report it stolen) He probably wants to charge you to defend THAT case LOL

We only had a copy of the front of Hachemi's GC with the incorrect spelling of his name. We sent the GC back soon after receiving it to get his name corrected. Even though we had delivery confirmation, USCIS lost the GC and I-90. The whole 2 yrs Hachemi had I-551 stamps, all the time USCIS claimed they couldnt find it. Right before doing lifting of conditions we made an infopass appointment to see if we needed get his GC before filing. At the infopass she made a call and said it was so close to filing for lifting conditons that we wouldnt need to get the new GC. With the I-751, I included the copy of the front of the incorrect GC and the story about sending it back, Uscis recieving it, never getting a new card, the numerous infopass appts and even included a copy of the delivery confirmation. The reason I say this, is I think if you explain that it was stolen right before filing and include a copy of the police report, they may accept it. To be sure I would make an infopass appointment like we did. I wouldnt worry about calling the misinformation line. They probably have no idea what to do.

Another thing that the lawyer told me: he said that I have till oct. 31st to mail my package. Would I get my replacement card before the 90 days???? What should I do???? OH MY GOD!!!! He really told me "you have only 31 days to mail your package" my green expires on january 15, 2010 so my 90 day window starts next month (oct.) Has somebody mailed they package right before the 90 days expire?? I just don't want to send it too close to the expiration date.

How long does it take for them to mail the new card? does it takes less than 2 month???

Another thing I will DO tomorrow morning is call the USCIS local offices here in new orleans and ask them for an appointement. Should I call the local offices or call the main center???? Can I just show up without an appointment????

Should I hire a lawyer???? (so he can go with me to the appointment) I really don't care about the money I just don't want to have any problems getting my permanent resident. We do have 2 girls together (a 2 year old and a 2 month old) with my USCitizen husband, shouldn't this be enough evidence of our marriage???? I remember when we went to our interview the first time.....I got there with my husband and my new born baby, and also I remeber I took all kind of evidence with ous, but the officer that did the interview just took a look to the baby and said "this is enough evidence, I don't need to take a look at all this things"

Here is the link to make the appointment at USCIS. http://infopass.uscis.gov/ I would make an appointment and ask them if you need to send the I-90 so close to filing for removal of conditions. I dont think a lawyer is needed.
