Read what the comments of a Director at the VSC were regarding CSs at the top of the K-1 forum. His wife is also from Russia and arrived without all her vaccinations. He went to the local county health dept., got the vaccinations and sent the records to a CS, just like you. I have never seen and he never mentioned in any of our discussions (and this was a topic we discussed at length) about having to see a CS in person to sign the I-693

The signature is also the only issue I can think of. The instructions on the I-693 do say this:

You must sign the form in the presence of the examining physician.

That might be the source of the problem, IF that bit of instruction is actually derived from law code or regulation, but I would be a little surprised if it is.

I was about to suggest this as being the reason.

found this on USCIS:

USCIS may revoke a physician’s authority to act as a civil surgeon if the physician regularly fails to follow CDC's Technical Instructions, or has fraudulently completed a Form I-693, or has had his or her license suspended, revoked or terminated.

Signing it without the presence of the examining physician "could" be considered fraud.

True, except with a K visa there IS no "examining physician" as there is no exam. There is a section for K, V and asylum visas which excludes them from an exam if they had one overseas. It says only that a CS "must complete the I-693". The I-693 has both medical exam and vaccination sections. This would be correct if there was an exam, but there isn't.

guys i guess there is something wrong with portland , this is not the first complain this month , another guy who had his interview in portland and said they refused his vaccines because it was from Dr Arnold ( while Dr Arnold is still recommended by USCIS AND THEIR WEBSITE )

sorry to interrupt here , but did you go to an interview and told this ? or they called you without an interview to tell you this because everybody else has been using Dr arnold without a problem . except for another guy in portland that was told the same in portland .

You are not interrupting, thats what we do here, try to learn and help each other. We went to final AOS interview in Portland. We were told about completing vaccinations, which we were already aware of and planning. When we left office that day, we drove 4 hours home to Northern maine back country. , and went for shots. No one had the flu vaccine in Maine in October, too early and severe shortages nationwide. We we given 30 days on our paperwork to complete medicals. We arrange to wait two weeks for flu shots, then in the mean time, called CS to setup appt. Without re-stating previous posts, when we didn't want to pay $530 for a full physical again from ( the real scammers) and the other ONLY two CS doctors were not an option, we were running out of time. We finally had all shots from a health clinic, and needed a CS to sign us off, but now it was one week before papers expired and we called Dr Arnold who told us to do this routine and he would Fedex back to us in 2 days after review, which he did for $30.00, which covered postage also. We forwarded all our papers the DAY before the deadline and 17 days later, while waiting for green card., we got a phone call from USCIS officer that interviewed us asking when we arrived back from Texas. When i told him we didn't go to Texas,, he said, i figured that, and that this was a fraud and a scam, that we had to go find a CS all over again, that said that although we DIDN'T do anything wrong, we need to see a CS in person and not deal with this doctor that was being investigated. I was not happy with this call and my wife was very upset, so we consulted an attorney who answered our VJ posting, and we called back USCIS and told them that we fulfilled our obligation as far as we are concerned as to what we read on our instructions, and to send us an RFE or rejection letter, as called for , with USCIS problem matters and asked that he forward us the EXACT wording that was in questions and where it says that we are in violation. I am waiting for this paperwork before i can proceed with this attorney to look at this and make a decision or call for a hearing...thanks for asking...J

I haven't, but I have had WAY too much experience of the opposite to know that this IO is messing with people and making new legislation from his desk. As we would say in Texas..."Someone needs to jerk a knot in this guy!"

the guy that had the same deal with the uscis officer is leaving the US soon because his AOS was denied because his wife removed the I-864 , but he feels very bad because the officer was very rude to him , I was in contact with him ,

i will pm him now and ask him to send you his phone number .

Is this IO referring you to any particular doctor? Just curious.

Just to answer a question asked earlier in this thread re: the flu shot being required for the AOS. Some of the vaccinations required are dependent upon the age of the applicant and also the time of the year. It is now 'flu season' so getting a flu shot is the recommendation from CDC - thus it becomes a requirement for the AOS during flu season. It does seem rather peculiar as it means you could be vaccination compliant and complete when you apply but by the time they adjudicate the application it could be flu season and you now require another vaccination. Maybe this is something Gary and Alla can ask his Director friend about - how strictly do they enforce this particular vaccine?

No, just gave us a list in Maine.Included 1 an hour away where we live, wanted BIG money and would only do FULL physical, another one 2 hours away was less money, but full physical. One was not familiar with process and wanted us to drive 2 hours to see form to make decison.

Good question. I will ask him. FWIW Alla arrived in September, we filed her AOS in November and we had our interview in January and no mention of flu shots, but the pig flu was not such a big deal at that time.

Good luck and I'm happy for you. Each posting that I get, just strengthens my case. Like i said, this is an isolated officer , trying to make his own agenda, for what reason I will never know, but with the list of people who are still getting approved, it just proves my point, that there IS nothing wrong, and like I was told over the phone and i have a recording of, I was told, its ok, you didn't do anything wrong, but this doctor is illegal, so just go and pay someone again and make it right....ya, just what I need to do...Thanks..jb

I want to add that i spoke to Tammy in Dr Arnolds office and as far as she is concerned, they are doing everything by the book for years now and no, including USCIS or any field office has ever questioned them, called them, or sent a letter pertaining to their services. Ony a lot of thank you letters for speedy service. She asked me to call her if I found out a specific reason, but she and i now both feel that this is an isolated incident with just the Portland Maine office and possibly just ONE officer, so if anyone has had issues down there, now is the time to speak up...cheers...J
