Wonderin if this has happened to anyone lately, I petitioned my husband and he had his interview @ CDJ 9/14/09, at his interview the consular officer told him he was eligible to apply for a waiver and to expect more info via DHL that same day or the next. When we picked up the DHL packet they had sent him the same "blue" form saying he was not eligible to apply for a waiver until 10 years had passed.

My husband did have a overstay of 1+ after entering illegally and had been previously stopped at a port of entry trying to enter illegally and was sent back so we understand that according to the USIS laws the 10 yrs apply but can they tell you one thing and then turn around and say another?

Has anyone known of the 10yrs being appealed and won?

Check with a lawyer. Laurel Scott in Texas does a lot of waivers. Expensive tho.
