Hi all!

Please help me with my problem what should we do?

We've filled our second petition on 05/26/09 (same fiancee) now they told me that I must request a waiver, since petition was filed withing two years period(first was approved on 06/06/08).

A few days ago I received "Intend to deny" letter and it says I need to request a waiver with a valid reason for it. I understand that if I send them a heart-braking letter describing my situation is not a good reason for waiver approval, but my fiancee left USA because we had a fight, and I described this fact in my petition. Do I have a chance to have waiver approved? Should I make an appointment with USCIS officer, hire an attorney, or just get married and file K3 petition?

I am not sure if this helps but Marc Ellis believes that if it is the same couple the regulation should not apply.

Maybe the correct response is that because you are the same couple the two or more beneficiary cluse has not been triggered

Thanks for your answer, I hope it will help us. But anyway of Marc's believes they asked us for a waiver ((( And we have just stupid fight as a reason.

But I forgot to mention one more problem- when my fiance was filling petition he made a mistake in my name, when we've figured out this mistake, he called USCIS and they put the right one (we have document "name correction"). Now, they ask us to submit documentary evidence to establish that Wrong name and I is the same person. Is it possible that they request a waiver bc they think that there are different fiancees?

I do sorry for my English and do hope that you understand what I want to say .

Absolutely. Apply for the waiver - I think the fact that it is the same person works in your favor, and they wouldn't have encouraged the application if it weren't possible.

Yes, apply for the waiver, I think you should have no problem, you did nothing wrong, in fact you did exactly what you should do if you did not go through with the marriage.
