Timeline

Well as some of you know, we filed our petition and Received our NOA2 on March 25, 2006. Our file was then sent to the Consulate in HCMC. Huong Received her packet three in the mail, and returned it. During this same time the Consulate returned our file back to USCIS due to the new IMBRA law. The consulate told me that the DS-230 and Applicant Readiness papers that she sent were received after they returned our file, and therefore cannot be used. Finally we are getting some movement, and have already returned the RFE due to IMBRA, and are awaiting the Reafirrmed Approval. Once we receive this and they send our file back to the consulate she will have to wait for them to send her packet 3 again. So basically we are on the same timeframe we were when we first started in March. Before returning her Packet 3 I had her make copies of the original documents before filling them out. Is it possible that she can fill these out and send them to the consulate once we know they have received our file? Or she can fill out the ones online and return them? Would they accept either of these? If IMBRA never affected us she would be having her interview at the end of this month, but now we are looking at another 3 or 4 months. Any advice for us would be greatly appreciated.

Hi Mike,

Keep the faith,

Just make sure that your I-134 notorization and all otheres are documents are going to be within the expiration period. As for the packet 3, try to contact the consulate and see what they say, otherwise you may need to wait. Lets hope it will not be an additional 3-4 months.

I have been wondering about how long some of these notarizations and papers are good for. Does anyone know how long these are good for:

Any Notarization?

Employer Letter?

Bank Letter?

Single Status Paper?

Police Certificate?

Translations?

Anything else you can think of??

Does anyone know if our file will be worked on based on our NOA1 date or just the order they receive them?

I'm sorry I don't have answers to many of your questions. I don't want to make guesses, because we all know how risky a guess is during this process.

After looking at my fiancee's police certificate English translation, it noted on there that it was valid for 6 months. I'm not sure about the other documents, but just wanted to pass that along. You might have your fiancee check her police certificate to see what is the valid length listed.

Packet 4 instructions for us stated the I-134 "must be signed by the sponsor and notarized by a Notary Public no more than one year prior to the date of the interview."

Packet 4 instructions for us stated the employment letter "signed within the past year."

Congratulations on getting some movement regarding the IMBRA situation and your case. I was just thinking about your case when I was reading through the K-1 general discussion page and noticed many post of users receiving RFE's.

Keep the faith and positive thinking. Anything else will drag you down at this point. Things are moving and that is a good thing. Everything happens for a reason bud.

Best of luck to you both and perhaps a phone call to the Consulate would lend some detail as to how they will "reprocess" your case once it is returned back from USCIS.
