Hi Guys, I've been here in HI for over a year now under K3 visa, for so many reasons we're just starting to apply for AOS now, my question can I just apply AOS without EAD and AP(Advance parole)? I know they're optional and not applicable in my case, since I already filed my EAD way ahead of time(last year, around Oct, I think 3 months after I came in here) and AP is not applicable for K3, do you think it would be fine to just send the paper work for AOS without those, I'm just a little confused if I need to apply for another EAD(or is it renewal in my case) because my EAD will expire together with my K3 visa next year around June, I'm not even sure if my AOS will be approved first before my EAD expires if I send in the AOS now, just wanted to know what's the right thing to do, that is. to apply for AOS with EAD application(or renewal in my case) or just the AOS forms, thanks so much in advance for the replies, btw my K3 will expire next year 2010 and so is my EAD, and do I need to pay Aos of $1,010.00 even without new EAD application? Thanks so much in advance guys, your replies will be a great help. :blink:

Since you already have the EAD and you are a K3 no need to file either the I-765 or I-131 with the I-485. It still will cost you $1010 tho.

EAD and Advance Parole not necessary. Still costs $1010. We applied adjustment of status 1June, and had our interview and approved by 9 September, 3 months. She has her green card as of a week ago.
