Can you apply for AOS and AP but not EAD?

I also can't drive - I need to learn so I can't get a driver license until that happens anyways.

The requirements for getting a learners permit are generally the same as those for getting a license however, so you may have issues getting a learners permit if you don't have a SSN.

we applied only for AOS and AP when my husband filed last year. he intended to go to school full time and not work, so we figured it would not be a problem. of course, we also thought that by now our application would be approved, and he would have green card in hand.

unfortunately, we're stuck in fbi namecheck limbo.

if you have no intentions of working, then i would say you'll be fine without the EAD. once you leave and return with AP, your new I-94 will say "parolee" and will be valid until the expiration of your AP. anthony has used this document several times to prove that he is here legally, including when he has applied for and been awarded federal financial aid.

we applied for his SSN about 2 weeks after his entry to the US. It took a little convincing on our part that K-1's were actually eligible for a SSN...but it soon arrived in the mail. after the arrival of his SS card, he took it along with his passport and was able to get a MO driver's license. (remember, driver's licensing laws vary from state to state)

I guess if you want to spend $180 + normal fee to get a driver's license that is good for 1 year then you should get one.

I got an 8 year driver's license here in NC (I live not far from where Jay is moving to) with just an NOA for the EAD as evidence of my legal residence.

Jay, your AOS applications at Charlotte are going to take anywhere from 9 months to just about 13 months. (going from the timelines here at VJ and my own experience, barring any unforseen RFEs) The EAD card if you choose to apply for it, will be the Only immigration ID that shows you're here legally and have legally applied for AOS. No one here understands what the heck a K1 visa is (or K3 for that matter) so you may have difficulties with banks, etc without proof of your legal status.

That said, my own experience in the area has been that only employers and bankers ask me for ID, I've not been stopped by police or anything like that, so all this may be moot. They don't cotton too well to immigrants around here, but you've got a funny accent, so they may like you despite that ;)

Anyhow, as stated elsewhere, if you need any help finding your way around to any of these offices, let me know. I've been there done that :)

In SC they would not let me get a SS card in my married name until I showed them my EAD. Even after I showed them my EAD they had to send all my documents to the DHS for verification because only my maiden name was in the SAVE system.

I could also not get a drivers license without the EAD - when I asked what one would do if they were not planning to work, the DMV basically said you would not be able to get a drivers license until the Greencard arrived.

The system is just so backwards and ridiculous, but we just have to ride with it. If you want a SSN in your married name and a drivers license you might be better off just getting the EAD so you have some official identification in your new name. Then again it might just be that SC is more backwards than anywhere else (most likely).
