Another question (which has kept me awake at nights!) to the pros here - as this is the only place I know!! :unsure:

The GC we get now is conditional, right? I read somewhere that it is conditional for 2 years and then you renew it! What is the condition based on - marriage and location? I ask this question because of the scarcity of jobs in the US now... do we have to maintain US as a primary residence during these 2 years?

Some one please enlighten me...

My understanding is it is conditional for 2 years because you have been married for less than 2 years. You then reapply 90 days before the 2 year expiration and receive a 10 year card. I have a friend who came here already married and she had been married less than 2 years to her husband. She came here on a spousal visa and her GC is only valid for 2 years. She will also have to reapply at the 2 year mark.

Boy, lookin' at the September spreadsheet really helped to predict when this would hit. I called this timeframe 2 weeks ago, almost to the day, based on the average days in the September spreadsheet :)

FYI:I had had NO touches on my I-485 since October 23 until I got this email today. So don't panic if nothing seems to be moving.

Yes. Permanent Residents are expected to reside in the US, well, permanently. The precise guidelines are in the faqs but it's something along the lines of you cannot leave the US for more than one year continuous [without a re-entry permit, filed for in advance along the same lines as advance parole], and must reside in the US for at least 50% of the time, in aggregate, otherwise you forfeit your permanent resident status.

Once you're a citizen, otoh, you can do whatever you want, but while you're a PR, you're expected to spend a substantial majority of your time in the US.

As to your first question, the condition is based solely on marriage. When you file Lifting of Conditions, you give them a whole bunch of evidence showing that you have been and remain married and living as a married couple [with co-mingled finances, etc]. Assuming you have not forfeited your PR status, and are still living as a bona fide married couple, it's no big deal. There probably will be an interview though, especially if you didn't have an interview during the AOS phase.

thanks for answering the question - with the current economy, jobs are no more secure, and I was thinking, maybe moving back to Europe or even maybe Canada wt my hubby, as here no job means no medical insurance... :( It sucks.. after all the stuff we went thro' to be together. But hopefully, times will change and we get some good employment options here in the US! Praying and hoping for a better tomorrow~

WOW- I like the way this is moving... definitely since you haven't had any touches in FOREVER. Maybe we do have some luck! Did you also get EAD and AP? Just trying to see how all the successful cases look. Awesome anywho- CONGRATS AGAIN!
