Boohoo. Seems like some of us dont have a bright Monday this week. Just got RFE as well.

Its say : In order to process your application further, the petiotioner/sponsor on Form I-864 Affidavit of Support must submit all supporting tax documentation (W2's, 1099s etc) submitted to the Internal Revenue Service (IRS) for the most recent tax year.

We submitted 2008 W2, 1040 and Tax Return Summary from H&R Block.

What else do we have to send to USCIS now?

Any input on what should we do guys?

Its say : In order to process your application further, the petiotioner/sponsor on Form I-864 Affidavit of Support must submit all supporting tax documentation (W2's, 1099s etc) submitted to the Internal Revenue Service (IRS) for the most recent tax year.

We submitted 2008 W2, 1040 and Tax Return Summary from H&R Block.

What else do we have to send to USCIS now?

Any input on what should we do guys?

Sorry to hear that, I feel your frustration. We sent in as much info as possible but we didn't send 2008 tax return so I hope that'll work plus up to date pay checks etc. It said there was no evidence to say my sponsor earned up to/exceed poverty guideline but in reality, all of the 3 tax returns we did submit were well over the poverty guideline. My husband works freelance and has contracts here and there so it gets confusing. I don't even know what W2's, 1099 are! Back to square one I guess.

Sorry to hear about that. You gotta wonder sometimes. Maybe they lost your tax documents?

Anyway, just submit what they are asking for. Did you submit the full 1040 with all schedules and 1099s? You could also get a tax transcript from the IRS. It takes a week or two by mail, but you can walk into an IRS office and get one immediatly. It you do submit a tax transcript, you should also submit the W2 and 1099 even though it says they are not needed when you use the transcript.

BTW, what's the date on the RFE?

Im sorry too that you got RFE too. I guess what you have missed is 2008 tax return? Yes somehow the RFE is so confusing , but I hope the 2008 tax return you are going to send will make a good reply to the RFE.

I think mine was the opposite. My husband was a full time student before 2008, so I am not sure how we are going to deal with this RFE.

We did submit pay stubs, employment letter as well and his salary is well above poverty line too.

I wonder if anyone here has experienced this before could give any suggestion? I will need to discuss this with my husband once he get home from work.

Thanks for the laughs you guys! BTW when I told my husband today that (YES) we were touched again- he said, "so they just like to touch you, that's it!" Anyway it is better than the K-1 which still says pending on USCIS- I never got any updates on it.

p.s. I love this forum!!!!

Yeah at least getting touches means they haven't forgotten you!! It would be awesome though if they scanned the document and let you know what they did. Like "Touched: 11/8/09; don't get excited, we just looked at it" or "Touched 11/8/09; look out for a bio letter!"

1. Im done with my Biometrics, what happens next?

2. Once you got your I-797C(Appointment Notice), does that mean that you wont be getting an RFE anymore, as far as the documents that you've submitted is concerned?

You may not have had any 1099 for 2008. Form 1099 is a tax information statement you would receive from a bank, stock broker, etc. The 1099 reports "other income" like interest income, dividend income, misc compensation.

If tax returns for 2006 and 2007 were not required to be filed with the IRS, just include a statement that they were not required to be filed due to no income. But it sounds like your RFE is for 2008 data.
