Thanks I got the notice because I was there with her and it just says your case is being returned to the cis because the they did not beleive we have a bonifide relation ship. How can i get the exact reason that they used to make that determination so I can address it before my CR 1 interview. My notice 129F says that it expires on 10-8-09 will they just let it die. It has not been returned as of yet.

As I said: My senator got the exact reason for denial. It was mainly lack of a bonafide relationship do to lack of pictures with me and my lady's family.

I hope you don't get the wrong idea from me - about you using the Immigration Liason person at your Senator's Office. I'm not discounting, at all, the fact that it worked for you. I will suggest, though, STRONGLY - that the IV UNIT at Guangzhou is not so friendly to Immigration Liason staffers, and that's based on a bunch of 'others' anecdotal evidence' over the last 2 years.

I think it's GREAT you got a fast response - I sorely wish Guangzhou did the same with the Immigration Liason Staffers - near as I can surmise - that's JUST NOT THE CASE. Things could change, though, yes????

FWIW, Guangzhou IV staffers use the 'Not a Bonafide Relationship' tag to cover whatever the #### they want to, without further explanation. Near as I can tell, they will review the casefile prior to interview day, find something amiss or lacking in the CASEFILE, then on INTERVIEW DAY, ask the beneficiary a series of bogus questions, in an attempt to trip up the interviewee. Once the VO has tripped up the interviewee, they have 'cause' to use the 'not a bonafide relationship' tag.

It sucks, greatly.

But - it's been like that for about 3 years now. Things are changing at GUZ, thank god, but only time will tell if it is a significant change.

IMO, the long and the short of it, really is - wei - Make your petition file as COMPLETE AS POSSIBLE on the day you submit it to USCIS.

okay maybe i got it wrong maybe its not 221g??

This is what it says:

Dear Immigrant Visa Applicant:

The consulate is unable to issue you a immigrant visa because, according to the section of the Immigration and Nationality Act section 5A you do not fulfill the eligibility requirements for the petitioned visa. The consulate determined, based on your testimony, documents, and any other evidence that you do not have a bona fide relationship with the petitioner. The consulate will now return your case to homeland security, CIS for review and possible revocation.........

Is this 221g or something else it does not mention 221g the slip was white

In my experience, a detailed review of the interview questions and answers will reveal the reason for the denial. If the relationship isn't believed to be genuine, the beneficiary is usually quite clear on the reasons, whether they choose to share them or not and usually, the petitioner at least has a clue.

If you hire professional assistance, one of the first things they'll want is a detailed account of the interview, so if you don't have it, get it. Second, if you pursue the CR1, be aware that time together is the strongest evidence of a bona fide relationship. The second most important thing for success is adequate preparation for the interview. She should be prepared to answer questions about you, your family, your job and your life. Pay special attention to any questions she failed to answer confidently and correctly in the first interview.

Just a quick update, went back for the Cr-1 6 weeks after a K-3 denial and got the pink slip and visa in hand I'll try and write a review when i get a chance. First question asked is your husband here of course she said he's down stairs waiting for me then she gave him my passport. Also it took 7 days to pick up visa from post office not the two it says on the pick slip.

Congratulations. I'm seeing more and more reports of delays in picking up the visa. This can become quite expensive for the beneficiaries. I hope they solve these problems quickly.
