I-184 and Joint Sponsor

Hello, Does anybody know if I meet the requirement for I-864 to sponsor my wife and son? On my Tax return I made 45k 2006, 57k 2007, and 17.5k in 2008 (unemployment benefits) I just started a new job last week, I can get a letter from my boss but no paycheck history for this year. I want to ask my dad to be my joint sponsor he made 26k in 2006 and claimed my mom as dependent. Do you think I qualify or do I need a co-sponsor? I live with my dad same address. Thank you for your help.

As long as you make above the poverty guideline, then you are fine. In 2008, I think the poverty guideline is $17,500 for a family of 3, thus, you are only 100 bucks short of that level, but there is no need to include your father as co-sponsor. It only complicate the matter even more than it already is. Go ahead and include the tax returns for 06, 07 and 08 along with Letter of Employment from your current employer stating your start date, position and salary. Then you are set to go. thank you for your help. One more question, since I just started this job, my income from now till end of the year won't be over $22,877 for 2009. Do you think it's going to be a problem?

Timeline

As long as your annualized income meets the requirement you should be ok. By the time of the interview you should have enough time at the new job to show some pay stubs to support your claim and the employer letter.

This question had been raised many times in the past and Chuck said it best ... Think Big Picture. Making barely under the poverty income guideline for one year will not break your case. What the CO looking for in you is your ability to support your family from this point forward. If you can demonstrate that you will take good care of your family and not let them become a burden to society, then there is nothing to worry about. Like I said earlier, Letter of Employment from your employer for 2009 is sufficient. When I filed for my wife's K1, I started a new job also and I used that letter without having any problems.

He's filing for his wife, so he's using the I-864 and not the I-134. The I-864 has fixed rules. The consular officer has no discretion. Either he meets the requirements, or he doesn't. If he doesn't, then he needs a co-sponsor who does. In that respect, he's better off because HCM usually won't accept a co-sponsor with the I-134.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
