Hi,

I have just married my american fiancee and will change my name to his shortly. I can not change my australian passport until i return to australia. Should i use my married name on the AOS forms, or should i continue to use my maiden name?

Hi,

Use your married name. My wife is in the same boat and we have had no problems so far.

K1: 01/15/2009 (mailed I-129F) - 06/23/2009 (visa received)

AOS: 08/08/2009 (mailed I-485, I-765, & I-131) - 10/29/2009 (received GC)

use your married name because what ever name you use thats what will be typed on your greencard, if you already have your SSN once you get your EAD you can go back to the office and get that changed too. im not totally 100% sure but i think you can contact an Australian Embassy here in regards to changing your passport name, but when you apply for your AOS do the AP (advance parole) as well (seeing its included in the price) you will need that if you want to travel outside of the USA until you get your greencard, also carry a certified copy of your marriage licence to for travel reasons. just so the people at immigration at the airport know who you are ...good luck and aussie aussie aussi oi oi oi lol

2009-11-05 Went to change my SSN to my married name but was told it wasnt in the system yet i receive mail from USCIS in my married name

April 15th 2010, received email that my green card is on its way woohooo!!!

April 23rd 2010 received my greencard today

Not sure where you were married but I was married in Las Vegas and found out on Friday that to change my passport, I have to change my name via deed poll because they do not accept overseas marriage certificates.

It may be different though if you do the name change from over there via the Embassy ... good luck :)
