I have solid evidence of bonafide relationship and fiance plans to attend interview with me... I think I should be prepared but not worry too much about it. thanks :)

my only concern would be like what others said...they may question you whether or not you are really genuine in this relation since you were in a same-sex marriege but now you are married to a male..so they may think that u are doing this just to get the the US paper.

It will be interesting to see how they handle it.... if it becomes an issue at all.

Hmmm. But now that I think about it.... You may be more scrutinized if they think you are marrying a male to bypass the US immigration laws. I'd make sure I had lots of evidence of the validity of the relationship if I were you. And it's probably advisable to have him at the interview as well.

Yeah, that's what I was thinking too. Of course lots of people are bi, but they MIGHT look a little more closely than they usually do at Canadian/American couples---if they suspect maybe you are marrying a friend so you can immigrate to start a life with your female partner or something. My guess is it won't be an issue.

You probably could have married a man named Cindy or something like that... I've seen weird stuff like that before!

I do not think it should matter, since the documents are all kosher and your marriage was legal in Canada. However, you might get one IO asking your very unpleasant things. Example: "how do we know you are not marrying a man this time with the intent of circumventing immigration law and in reality cohabitate with a woman?" "uh oh... so you were a lesbian and now you are not , eh?"and ####### like that.

They are not the smartest cookies in the jar sister - and even though they have to adhere to standars of dignity, they do cross the lines some times.

We will all be rooting for you. And then again, I think it should not even be an issue.Canada's laws should be respected as much as any other country's laws in this case.

As I said, it's highly doubtful, but sodomy can be defined as including oral sex. This would, of course, invalidate a huge amount of straight couples as well, but there you have it.

That said, you should know that an overzealous adjudicator may attempt to deny your visa due to sodomy and/or lewdness being a crime of moral turpitude. But that's highly doubtful.

Incredibly doubtful, plus it's good form to wait until at least the 2nd or 3rd page before dragging something amazingly obscure out as to be irrelevant :hehe: (see the whiteout or not? thread here for an example)

But anyway, KnJ, it probably won't be an issue, the whole bonafide thing, I hope it isn't and good luck :thumbs:

Your problem is going to be one of legitimacy. Since you have had a same sex relationship in the past, the presumption is that you will continue that type of relationship. Since one cannot immigrate to the US based on that type of relationship, the presumption by the consular officer would likely be that you're using a male as a proxy to gain entry to the US to have a relationship with a US woman.

And despite comments to the contrary, the consular officers are not dummies. Only the best and brightest are chosen to enter the foreign service. It's one of the toughest jobs to get in the US government.

Tread lightly and be prepared for some difficult questions and perhaps even an investigation on this matter. Be prepared with evidence to refute their presumption. Don't be surprised if they don't make a decision immediately after the interview.

Hmmm i have relatives and friends in the Foreign service, guess they slipped by,lol

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1
