Do they really perform review on the evidences that petitioners submit? Or it is just a formality and eventually deny those who fall under the AWA? They listed on my NOID to provide the following:

1. certified completion of rehab

2. certified behavior evaluation from psychologist, psychiratist or social worker

3. Proof of community work

If the results of the above are affirmative, would they have reason to deny it?

What were you charged with? how long ago was it?

When you filed did you send any information a long ? What did you send?

by rehab do they mean probation?

and what if you have no community work ? Not many communites want a sex offender helping them with anything?

And how can they actually prove you did something for the community?

What were you charged with? how long ago was it?

When you filed did you send any information a long ? What did you send?

by rehab do they mean probation?

and what if you have no community work ? Not many communites want a sex offender helping them with anything?

And how can they actually prove you did something for the community?

My conviction was 20 years ago and from that time on never violated any law. My wife was already in the US when we got married. When i filed for petition, there was no question or requirement asking me to bring information. They asked for info during the interview and later in the NOID. Rehab pertains to rehab during the period of probation. Thats when I had mine. As for community work, maybe neighbors affidavit would do.

I am not sure if you are seeking answers as you are in the same situation or you want me to clarify it before you give me your answers. Hmmm whatever I hope somebody will contnue to post their thoughts about this issue.

Timeline and immigration stage you are at would help.

It had been a while sunce your post, sorry you haven't got answers you were looking here.

Let me ask you, Eagerly, how did situation developed?

How long did you have to wait before you got NOID with request of 1,2,3? What did you do and did you got an answer from USCIS?

I'm on a similar position. I'm a wife of AWA petitioner. We were waiting for interview 1.5 years and on the interview Lady stated she will send us what proffe she wants that he is not a threat to me, untill then she can't make a desision. It had been over 4 months since interview and no letter from her.

So I understand your concern if this request is just a step they have to do, or an attempt to go on case by case basis.

Well, should be the 2nd, meaning give the person a chanse to have a 2nd chance in his lofe, but, we had a denial experiense also, on our 1st case. The time frame was unrealistic, I think we didn't met it, at least in denial letter there was no reference on them getting our papers, instead a qwote from my husbands complaint letter, interpreted like refusal to comply. I have to say it was all twisted.

Why we sent a complaint letter? Because I was 6 month pregnant and lady was very rude and openly juged my husband (she even didn't have details on his case then, she was assuming, I guess) and my moral position. The same time, she never asked if I feel safe with him, amything about our life together.

Unfortunately, on our 2nd interview Lady didn't ask any qwestions about our life too, just verified my bio information adn made a copy of a passport. At least she wasn't rude.

So, I feel strange about ther ways to evaluate threat level. Even assuming that I will say all the best about him, aren't those qwestions when they are juging our marriage, should be asked? Or community work is more important?

Did you, guys had interview?

I wish I could be help, but I ask more qwestions myself then helping. Sorry.

And community work as evaluation of being not a threat is funny for me too.

How long you had been married? We - over 3 years and have 2 year old daughter together.
