Does anyone know this form...I797??

Timeline

Hi yes I am anixous I called the uscis # about my rfe that they have sent out

they told me it was mailed on the 17th...I still have not received it. They also said that

it was form I797 that was mailed and to follow the instructions...of course this was a computer and not

a person. So does anyone have an idea of this form and what it contains?

My Fiance is on me to find out so we can be a step ahead but I don't know what else I can do

to find out more.

7-19-07 we met online

4-15-08 Mo asked me to marry him!

8-5-08 went to Italy to meet Mo (best time of my life)

4-4-09 returned home to file K-1

5-27-09 mailed in I-129F

5-28-09 Vermont center received package @ 12:34pm

5-29-09 NOA1 mailed to me

6-2-09 checked cashed

6-6-09 received NOA1

9-24-09 received RFE

9-24-09 returned RFE with correct info

9-25-09 they received RFE back

9-29-09 they resumed case processing

10-8-09 NOA2 was approved hard copy in mail Yea!!!

10-13-09 received noa2 hard copy.

Ok so that this is updated there was a change and we decided to go ahead and

get married in Egypt and not do the Fiance visa. We got married Dec 5th, 2010.

We filed I-130 in early March 2011 and our interview is Jan 12th, 2012.

The actual timeline has all other information if you wish to see it.

Coulda sworn the I-797 was the NOA2...

Naturalization

N-400 package mailed: 04/16/2013

N-400 package delivered: 04/16/2013

NOA1 date: 04/17/2013

Biometrics: 08/23/2013

Interview: 10/07/2013

Oath: 01/23/2014

DONE!

As Otto und Karin said, the I-797 is a Notice Of Action. It's used for NOA1, NOA2, RFE's, and probably other stuff as well. The form itself doesn't mean anything - it depends on what's printed on it. If you've already been told you're getting an RFE then you just have to wait until you get the form to see what they're asking for.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Thoroughly look over that copy of the entire K-1 petition that you made prior to mailing it out. Try to find what they are looking for based on your knowledge of reading the numerous postings here on VJ. Then you can be ready to send back the information they are reqeusting.

I'm not sure if this is any help, but I never received my NOA1 and I called USCIS and they told me they wouldn't mail another one. The computer also told me to follow the instructions on that form, but of course I couldn't follow the instructions if I didn't get them, so I just kept my fingers crossed. Then about 3 months after that I got NOA2, and that one I DID receive in the mail. Anyway, my point is, I never did follow any instructions, and my case went to NVC anyway.

You have my sympathy. I know this process is so confusing. Sometimes you are scared to do something, and scared NOT to do something also. Ridiculous they don't make the instructions clearer.

Interview ... WAIVED? Never heard of this, but they didn't even interview him, just told him pick up his visa the next day.

Current Status: Interview ... waived ... I guess :) They just took his fingerprints and documents and told him everything was in order and he should pick up his visa tomorrow! WOW

I can't believe it's only been 7 months since we filed ... seems like an eternity!

Coulda sworn the I-797 was the NOA2...

ALL Notices of Action (NOA) are on form I-797. If you have done evrything correct, the first one you receive (NOA1) is a receipt, the second (NOA2) is an approval. The second can be a RFE and then you will be looking for your NOA3. "NOA1, NOA2" etc are Vj terms, USCIS will have no clue what you are talking about.

There is no instructions on an NOA1 you need. It is a receipt. A receipt. That is all and by the time you would receive it you already know they have your case because they cashed your check and you have delivery confirmation of your package. The "instructions" basically tell you to wait for your next notice. They will not send another because it is a waste to send ther FIRST one.

As you see, there was nothing there you need, there was nothing you needed to be instructed to do. The APPROVAL, the NOA2 is another matter. THAT one you WILL need, do NOT lose it.
