New IMBRA Restrictions on Petitions Make Sense

Why wouldn't it be fair? Who am I to comment on the extenuating circumstances surrounding someone's love life and the reason why they cancelled their petition? It's not the PEOPLE filing petitions that cause the problems - it's the USCIS system that causes the problems!

Hahah Agreed .. the time it takes to approve or deny our petition is meaningless.. its the time it takes it to go through USCIS that takes time

If you're filing a petition for the first time, do you think it would be fair that you would have to wait in line behind people who have filed two or more petitions already?

I understand the need and want to speed up the process, but I agree with KitKat. There are better ways.

I don't have the right to question someones relationship trends. Why not limit the number of blondes one can date because the brunetts aren't' getting enough love. I don't know, maybe that comment is from left field but you understand.

I don't care who I'm in line behind because I consider myself lucky to even be in this situation.

06/30/06- sent I-129F petition to VSC.

07/11/06- NOA1 (received in mail)

07/19/06- RFE received in mail, IMBRA

07/28/06- e-mail, IMBRA RFE received at VSC

09/11/06- called VSC, told I'm with an adjudicating officer

09/25/06- called VSC, told to file expedited service, outside 60 days of RFE received date

09/26/06- sent expedited service request to VSC via fax and snail mail

09/26/06- Senators and Congressman making inquiries into my petition

09/29/06- expedited service request approved by VSC director

10/04/06- e-mail NOA2 approved!!!!!!

10/05/06- NVC received

10/06/06- NVC forwarded to Poland Embassy

10/16/06- Packet #3 received

10/17/06- Packet #3 sent to US Embassy Warsaw

10/30/06- Packet #4 received

10/30/06- Interview scheduled for November 22nd!!!

11/30/06- Visa in hand, via DHL!!!!

12/05/06- Ania and I arrive together in the USA

02/11/07- Ania applied for Social Security Card

02/17/07- Ania and I were MARRIED!!!!!!

07/24/07- Social Security Card in hand- after some minor issues and a little procrastination :)

10/14/07- I-485, I-765, and permission to travel mailed to USCIS

10/17/07- Received NOA1

12/17/07- I-485 shipped to California Service Center for faster service

12/17/07- I-765 approved new card should be mailed within 30 days, Advanced parole approved

02/28/08- AOS APPROVED!!!! PERMANENT RESIDENT CARD RECEIVED!!!!! (card received couple weeks after approval)

Or like being in the Express line in the supermarket that is 9 items or less and you having 9 items and them checking out all the people that have less then 9 items first.. its just not fair.

If the goal is to prevvent fraud, then if the beneficiary doesn't get a visa or never enters the US afte being petitioned, should that be counted against the petitioner as strike 1? Perhaps USCIS should distinguish between a K1 applications abandoned before a visa is issued and those where a visa is issued and used?

If the goal is to prevvent fraud, then if the beneficiary doesn't get a visa or never enters the US afte being petitioned, should that be counted against the petitioner as strike 1? Perhaps USCIS should distinguish between a K1 applications abandoned before a visa is issued and those where a visa is issued and used?

My oppinion? Yes.. I think it should be counted against the petitioner as strike one for the I-129F petition.. But that is only if the petioner cancels it. Everything else is grey area in my oppinions

How much will this affect people.. not much .. paperwork takes .. a few months to half a year .. on average .. that is about 6 months.. then the interview part .. few weeks to a few months.. then they come over.. ok ..so they are here.. lets say months to a year.. .. OOPPS now you want to divorce.. ok .. well in most states you have to wait 6 months after a divorce to get married.. so you are sitting at about 1 year to 1 1/2 years of time gone by since you last petitions.. hmm doesn't seem like much time to me.

But who gives the government the right to tell you who and how many I can marry? The answer is YOU.. and ME...We are the ones that vote our members of government in to vote for us..

We the people gave the government that right. Don't worry though. If the courts find the law is unconstitutional, they'll strike it down.

Like we have any Representation in Government any more. Every new Law is not written in good Faith. Every new law is Agenda driven. We are more Socialized in the USA then ever before. I have absolutely No Faith in either Party. You know why there is a big panic in the General public of Xenophobia?? Because the Government won't enforce the Laws already on the Books when it comes to Immigration!! There is too much to gain Politically to Pander too the latest special interest group... Hispanics. My X wife is Hispanic. The Lawmakers only react to what they think the "Perception" of the public is... and then Pander to the Perception. The problem is.... The Lawmakers are so out of touch, They Don't Even Know What The Perception Of The Public Is Anymore!!! The Debacle over The arguements of Amnesty by BOTH Parties proves my point. 80% of the Population here does not want any form of Amnesty! Yet Both Parties thought America would go for it!!! lol!!! :no:

Not Polygamy!

There are Laws on the Books against Polygamy. Just Like Immigration Laws.

There is too much to Gain politically by "Looking the other way".

Im Not Totally Trashing Our Gov. We have the Best system as long as the Laws are enforced thats All. I have TWO Step sons Defending this Country Abroad as we speak my Friends.

HAHHAHAHA .. I completely agree man .. but I just laugh when I see "as long as laws are enforced.. " that is our downfall .. And I understand your point why should you be limited to how many people you can marry? You are not .. You must fill out a waiver if you have filed for what they deem is the limit.. You just have to justify yourself.

Again, how can you take into account individual circumstances? Are you going to penalize a man who, in the end, found out that his foreign fiance was in it only for the visa and he had no idea after 3 years in the relationship (this happened to a VJ member)? If he falls in love again next year and wants to file for another beneficiary, you wouldn't want him to have the right to do so?

I hold firm on the fact that it's not the number of petitions - or repeat petitioners - that cause delays and problems. IT'S THE SYSTEM OVERALL.

Listen people. My big problem with everything that has gone on with IMRA is the total lack of common sense in the implimentation and application of the the new Law. I worked for the State Of Ct. for a couple of years. It's the same way there... People on the top make a decision based in a good idea but wont contact and discuss it with the poor SOB's who must enforce the new decision. That's all.

I just believe that too much Governmental controll Slows Efficiency that's all. George Washington, Ben Franklin, Thomas Jefferson and even Thomas Payne agree with me on that point.

It just frosts me when people just accept the nonsense the Gov. hands out on a daily basis.

My apologies for the polygamy remark.

Societal norms are what tend to dictate what laws are written in these areas. There is a deep divide in this country over immigration right now. Given the current climate, tt wouldn't surprise me if more restrictions are placed on immigration as time goes by.
