New IMBRA Restrictions on Petitions Make Sense

I have no problems with your questions, sir. I have problems with your logic and reasoning. Hearsay, innuendo, and exceptions-that-prove-the-rule do not make a case for your arguments/advice. I for one thought your questions were basically rhetorical and you put your post on a soapbox. If you want to wear your opinions like a t-shirt, prepare to face people whose opinions are different than your own or those who will seek to debunk your logic. If you consider that 'flaming', and shrink from it, you should not have posted in the first place.

OK I feel that JSR is getting flamed for inapropriate reasons.. I agree that most here on VJ are here for actual love but there are people here that have been complaining about the multiple petitions and that is what he brought up and his point is Valid.. Please read what he brought up .. MULTIPLE PETITIONS.. I am sorry if you thought you found love and cancel a petition and then in less then 2 years find love again abroad.. you may need to start rethinking what is love..

Perhaps it is just the way I read it .. but that is what I see...

Why shouldn't there be a limit on the number of petitions you can file?

What is so unreasonable about having to wait two years after having the first K1 approved before applying for a second?

Any thoughts?

I sometimes get involved with opinions that are not well thought out and this might be one of them. My opinion is this:

I'm against the multiple petition restraint, period. It seems like they are trying to weed out non bonified marriages and immigration fraud. The problem I have with it is, they already make you prove your relationship is bonified in the petition and in the interview process. They make you prove your in love!! why kill the petition for this purpose before it even gets started!!! I think it's horrible and this part of the law definitely infringes on the rights of Americans, there should not be any!!! ANY!! limitations on marriage, period!!!!

That's just my opinion after 5 minutes of thinking about it!!

06/30/06- sent I-129F petition to VSC.

07/11/06- NOA1 (received in mail)

07/19/06- RFE received in mail, IMBRA

07/28/06- e-mail, IMBRA RFE received at VSC

09/11/06- called VSC, told I'm with an adjudicating officer

The reason I believe behind the multiple petitions is to keep the "non bonefied" people out.. I mean honestly I would not ask my fiance to marry me unless I knew it could work.. Now I had the luxury of living with my fiance for a year before engagement which many don't get with foriegn fiances.. but seriously I see posts here of people wanting to cancel their petition before the I-129F is approved.. C'mon .. how can you fall outta love that quickly? haha

What about the impact that limiting multiple petitions might have on immigration processing? If the number of K1 petitions being processed is eventually reduced, might that free up some resources to help USCIS speed up processing of other application types?

There should be a limit. You can't play with peoples lives like this.. the foriegner has a lot more at stake here..

wait 2 years? I think that is fine.. I would probably up it if I was in charge (many im sure are glad I am not). Many, many foriegn relationships are quickly moved forward.. (Don't put words in my mouths people).. It is true.. not all .. but many .. most relationships that happen close by are drawn out.. And there is reason for this.. absence makes the heart grow fonder.. ..

are innocent people hurt by the multiple petition restriction?? Yes .. there are .. but it benefits more then hurts..

Even if the law did work in in protecting agains non bonefied marriages, which it will. The only problem is some people who are true in there feelings and really are trying to have a bonefied marriage will get caught up in the law, that's not fair to them. Let the decision be made through the process that's already in place. The 2 year meeting in the petition and the proof of ongoing relationship in the interview process. If they can't do there job in finding fraud, then that's there problem, not the innocent people getting caught up in this mess.

That would be a selfish reason to only have your own or my own petition speeded up. The process is what it is, some should accept it for that.

Thats democracy for you, majority rule.. Yes innocent people get affected by it .. that is why there are waivers.. for that situation .. if say something legitimate happens and you apply for another petition withing 2 years.. then you send in the waiver because you truly care about them.

That would be a selfish reason to only have your own or my own petition speeded up. The process is what it is, some should accept it for that.

I may not be reading him right but I think he is talking about the future. not sure though.

I think the processes in place are currently good .. Especially the embassies cause I hear they can be ROUGH! ..

Just my oppinion but I think the thought process is .. the harder and scarier we make the process the less likely we will get non bonefied marriages.. (WE being the gov't)

so, the limitation on petitions wouldn't be necessary because they should be catching immigration fraud at the Embassy

If you're filing a petition for the first time, do you think it would be fair that you would have to wait in line behind people who have filed two or more petitions already?

It's amazing how little time Embassy staff have to make a decision at an interview about whether a relationship is legit or if it needs more scrutiny. If fewer petitions are filed in the long run, then maybe it would be easier to catch fraud at the Embassy level.

Andy, I'm with you on this.

As for reducing the number of K1 petitions being processed and potentially freeing up resources - doubtful. In the grand scheme, I highly doubt that K1s constitute the largest number of visa applications. Even if they do, there are much smarter and better ways to speed up processing. For example, they could hire more people like Vermont has. They could provide better training. They could provide emails that answer questions. They could provide information to their call center workers to actually answer questions. They could email petitioners with updates and information - emailing K1 petitioners information about the IMBRA situation from the getgo could have prevented a lot of needless inquiries via phone and email. They could get their sh*t together in the first place so things like the IMBRA debacle never happen.

Making it so that a handful of people cannot file multiple petitions will have no effect on these things.

Correct .. but that is work that USCIS and DHS, and all parties would not have to do if they caught it up front. Each petition requires a person to look at them and time for them to look at it .. and time is money .. and they gov't likes to be stingy with the money.

Why wouldn't it be fair? Who am I to comment on the extenuating circumstances surrounding someone's love life and the reason why they cancelled their petition? It's not the PEOPLE filing petitions that cause the problems - it's the USCIS system that causes the problems!
