F-1 Visa Holders...

had a question for you on f1 visa, or anyone that has any insight...

well we have our interview in 2 weeks and i was getting worried about my status. i was an f-1 visa holder and then i graduated june 12th. we sent out our AOS before my 60 days (before being out of status) were over.

however i'm really worried about the interview and the IO, will i need to prove my intent at the time that i arrived in the us? and how do i prove that i was going to return to my home country after my studies? have no real proof, my parents still live in london, had no jobs or houses, 1 bank account.

also, we got married in 2005 and we left the country for two weeks in 2007, to visit my family in england and i returned on an f1 visa, sent AOS in 2009. now we called a couple of lawyers and they said that the vacation would be forgiven because he is USC and we dont really have to worry about it, do you think that i will be asked about my intent because of this?

May 2002 -- Met online.

07/16/02 -- Decided to start a long distance relationship.

01/09/04 -- Finally met him in person when he visited me in London, UK.

June & Dec 04 -- Visited him in Los Angeles, CA.

07/10/05 -- Arrived in the U.S. on F-1 Visa.

07/18/05 -- Got married in Las Vegas, NV.

01/08/09 -- Visited London, UK with him.

06/12/09 -- My graduation, F-1 Visa expires in 60 days.

07/30/09 -- Sent off I-485 and I-130 TODAY!

08/02/09 -- Delivered to Chicago Lockbox @ 9.35pm.

08/05/09 -- Checks cashed.

08/08/09 -- Recieved 4 NOA-1's (I-130, I-485, I-131 and I-765).

08/11/09 -- Recieved Biometrics Appointment for 08/28/09 @ 10am.

08/13/09 -- Early (Walk-In) Biometrics taken today.

08/28/09 -- Original Biometrics Appointment.

09/08/09 -- Recieved Interview Appointment in Los Angeles, CA for 10/09/09 @ 9.45am.

09/15/09 -- EAD card production ordered.

09/16/09 -- AP document approval notice sent.

09/22/09 -- AP document recieved.

09/22/09 -- EAD approval notice recieved.

09/23/09 -- EAD recieved.

09/24/09 -- Applied for SSN.

10/02/09 -- Recieved SSN in the mail.

10/09/09 -- Interview Appointment in Los Angeles, CA @ 9.45am. APPROVED

10/15/09 -- Green card production ordered.

10/16/09 -- Recieved I-485 and I-130 Approval/Welcome letter.

10/21/09 -- Green Card recieved, IN HAND.

I don't think you should get worried at all. I think you should just focus on the evidence you have that you too are a couple. Since you have been married for a while now, they many require you to have a lot of evidence.

Hi there,

I am a current F-1 holder and pretty much have a parallel situation in the main.

You came an utilized your F-1 status to pursue full time studies and obtain a degree...the F-1 visa and entry is substantiated. AOS was utilized because of your marriage and made the decisions that you did particular to your final choice of living arrangements...Same thing goes for myself. I came to do the Ph.D degree but found ourselves traveling the marriage path earlier than expected and it certainly wasn't preconceived.

Evidence to show your bonafide marriage is key, everything else should be copacetic.

My interview is in October too....Good luck, fellow Brit!

We adjusted from F-1. We were not asked about intent. I don't think most F-1 adjusters are. You were a student for two years after you entered, it's pretty clear that you used the F-1 for it's correct purpose. If they ask you when you decided to stay in the US, it was fairly recently. (Being married to a USC does not mean you will stay here, you could have moved to GB, no?)

While F1 is not a dual intent visa, it is understandable that one can meet someone, fall in love and want to stay together. Hassles are rare for AOS from F1 so long as you have proof to back up your marriage. All the best!!!! :thumbs:
