Please Help-How do I come clean and adjust my status

I came to the US in 1999 with J-1 visa. I was advised by some lawyers that I cannot adjust my status in the US unless I return to my country. Someone introduced me to a worker for a congressman who took me to congress and said he can get me asylum in 2003. He filled the asylum application and added his last name to my name to show that I am his brother because he has decument to support that some of his family members have been given asylum. He used different date of birth for me and a copy of a passport from his country to claim that I entered with a false passport. I was denied the asylum and ordered to be deported to the country the guy said I was from in 2006. The guy was using his office in congress for immigration fraud. He has been arrested and put out of business. I have three children born in the US with a non US woman. The kids are living with me. Now I want to use my own passport with my personal information to come clean, and change my status. What should I do?

Consult an extremely well qualified immigration attorney who has dealt with similar types of cases in the past. You have a pretty unique story and set of circumstances so don't use just anyone.

Look for an attorney ... and do the change name infront of the judge, you have to tell them all the story's behind of your false personal information , to make it legally corrected. court order document will be your main documents for changing your false identity.

Not a DYI case. Yikes! Get Shark Atty, pronto! Sounds like that guy put the CON in congressman. Good Luck.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I resisted the temptation to reply to this topic yesterday...

There is no way you could have gone through the asylum application process without knowing precisely what this congressional aide was doing. I find it impossible to believe that you didn't know what you were doing is fraud, which means you are complicit in the fraud. At this point, it sounds like USCIS might believe you are the person you claimed to be on your asylum application, as evidenced by the fact that they want you to return to the country you claimed to be from. Any attempt to "come clean" at this point is going to amount to an admission of criminal fraud. This is a LOT more serious than a simple name change. You could end up in prison. It may be less risk to you to leave the US as ordered.

You should definitely consult with a good immigration attorney, but you should also consider consulting with a criminal law attorney.

You have a difficult case. You entered with inspection ( good thing ) overstayed the visa ( small bad bad thing ) have been here out of status long enough that the ban would be 10 years (big bad thing ) but then you let someone lie to the US government for you ( very very very bad thing ) The government won't care that someone guided you into this. They will see that you are telling lies to the government. For doing this the penalty usually is being banned from the United States for life. If there is any hope you need a very good attorney.

This will not be over quickly. You will not enjoy this.
