Timeline

I am currently a college student and my husband has just started his own company (basically, he's self-employed).

He started his company about two months ago.

My parents have been my sole financial supported until the day I got married which was back in September 2005.

I was told by their accountant that they would not be able to include me in their Income Tax Statement. They will be paying taxes for four people (mom, dad, sis, and bro).

My parents are willing to sponsor my husband. This would mean that we would have to look under 5 people for the 125% poverty guideline which is $29,250 for the year 2006.

Question: It says to inidicate whether the sponsor will be using their own income or joint incomes of sponsor and their spouse. If spouse is being considered as sponsor then they must submit a form I-864A.

However, I read through the I-864A script briefly and it says that the person being sponsored has to be a household member. If not a household member, this person must be on the current tax form, which he's not. My parents did not pay taxes for him because we did not know that we had to. I thought the amount on the tax forms just needed to add up 4 people and add one more person to figure out the poverty guideline.

Am I reading all this correctly? My husband and I don't live with our parents so he could not be considered a household member. My husband is not on their most current tax return which I-864 and I-864A requests.

Am I getting my information incorrectly? And if they are correct, is there any way around it where they can still sponsor my husband? I know it's too late to resubmit and make corrections on their tax return.

Timeline:

March 22, 2005 - Sent in Petition for Fiance Visa (i-129f)

March 29, 2005 - Had to resend petition (insufficient stamps)

April 8, 2005 - Attempt #3 sending Petition (is there an unknown conspiracy against me? i put $3 worth of stamps and it's returned to me)

April 21, 2005 - Received Receipt for k-1 visa (NOA #1) receipt was dated 4/11/2005

May 2, 2005 - Received NOA #2 (finally these people are getting their act together)

May 12, 2005 - Found out that NVC sent in my petition and all that good stuff to Korea on May 4, 2005 (i can't express into words how happy i am)

June 16, 2005 - Looked up our case number online to check our interview date..and our number was there!!!

Our case interview will be on July 14th 2005!!!

July 14, 2005 - Interview. and it was a....SUCCESS!!!!!

July 21, 2005 - My fiance and I are in the US of A FINALLY!! We have 90 days to get married.

September 21, 2005 - Coincidentally, we got married exactly 2 months after.

September 23, 2005 - Starting the Adjustment of Status and EAD process.

Perhaps I can simplify. "Mum" and "Dad" work and earn X dollars, all of which is required to satisfy the joint sponsorship for their household (4) plus your immigrant spouse. "Mum" needs to fill out an I-864A with "Dad" in order for them to use their joint income figure on their I-864 as a joint sponsor for you.

I am COMPLETELY confused right now.

I did some reading and noticed that I, being the one who made a petition for my now husband to come to the US, needs to fill out I-864 also.

Considering I'm a college student and make no income, do I still fill out I-864?

And would both my parents fill out I-864A?

This seems to be a really hectic process.

Is it possible for me to just wing it by having the minimum poverty guideline for two people (husband and I) of $15,612 in the bank as assets for the year 2006.

I have never gone through the tax return process EVER. I was always a dependent of my parents.

Is it possible for me to do that? It just seems less complicated.

Ok, I'm sorry if I confused you further. Simply put, you are always the principal sponsor, even if you earn nothing, you must fill-in an I-864. That's where parents come in. They will act as joint sponsors. Joint spsonrs fill-in another I-864 for their household, plus the immigrant (your spouse) = 5 persons. If "Dad" is using "mum's" income to help meet that poverty guideline figure for a household of 5, then "Mum" and "Dad" fill-in an I-864A that is attached to their I-864 (as joint sponsors). You still fill-in an I-864 as the primary sponsor. Better?

No, $15,000 in the bank does not meet the PG for a household of 2, as assets only count as 1/3rd of their value, you'd need more like $45,000 in the bank to do that.
