Hi there... I have a few questions and I'd really appreciate if you can give me some answers. My boyfriend of two years finally proposed a few days ago. I wasn't expecting it but it happened and I'm so happy!!!

He's been in the US for almost 8 years and he entered the country with a b-2 visitor visa. He then changed his status to student (f1 i think) and has been attending school regularly and maintaining his status with no problems since then. This fall he had to move to another state to pursue his PhD. (Sad) But now, since we're engaged and all, we are trying to figure out the best way to go to process his AOS. So, I have these questions:

1. When should we get married? As soon as possible or should we wait until I'm able to move to where he is?

2. If we get married and we filed the paperwork for his AOS... Can he still pursue his degree and receive funding from his school as he is currently doing?

3. Can we get married and wait a year or more to file the AOS paperwork or should we file immediately?

You are a US Citizen right?! Then you guys can marry any time you want to! And you can petition him as your spouse. I was on a B2 visa when i got here and then i changed my status to F1 visa last March. Since my fiance proposed to me, we tied a knot last August 10, 2009. So now we're processing the I-130 and I-485 petitions. Like after 6 months I can receive my greencard and be a permanent resident.

He can continue his studies if he want to and you can file immediately after you guys tied a knot!
