Hey all! Finally filing the I-130 today for my husband and have a last minute question. I dont see on the instructions from the Depart. of Homeland Security where I need four copies of the Biographic Form - but here it says I need to include 4 copies. can someone clarify? Also, the instructions say the passport photos need to be taken within 30 days of the petition, but his is dated from March and when he mailed them, I didnt get them until May. We were married shortly thereafter. Will this be a problem?

Any last minute suggestions would help. Thanks all.

I assume you're talking about G-325A? When you download the form and fill it out, it is already 4 pages. If you notice each page, they're exactly same. So, that is what it means by sending 4 copies, basically, fill all 4 pages of that form. If you're filling it out on computer, then it will automatically put fill out the rest of the pages based on what you enter on first page. Do note that this form has to be filled out by both you and your spouse (your spouse's form has to be signed by him/her).

About your question regarding passport photos, I am not 100% sure. Does the date appear somewhere on passport photos? If not, there is no way for them knowing how old the photos are. As long as the appearance is not changed drastically and if there are no dates on the photos, it should go through without issue. But like I said, I am not 100% sure. Maybe someone else here can respond.

Actually, the 325A is now only one copy. That changed in August (or end of July).

I don't know about the passport question, but I'm so "by the book" that I would have made my husband get a new one! Fortunately ours were within 30 days.

Our timeline:

2/88: We met in Sydney, Australia at a youth hostel! He's Finnish, I'm American-both were in our early 20s at the time and fresh out of college (so couldn't afford to visit each other's countries after that!). We had a three-day romance, then went our separate ways. He actually was going to Sydney a week later, but decided at the last minute to cut his trip short in another country and go early. Wow.

1988-1998: Wrote "snail mail" letters/sent Xmas cards, but lived our separate lives. I married someone else, divorced in 2006...he lived with someone for years and then that ended.

10/08: Because of a series of random life events, I Googled my Finn Man and found him (but no link to his email, and the website his name was on was in Estonian so I couldn't even read it!). It took me two weeks to find a link to someone else, who forwarded my email to him (we were both single at the time thankfully!!!!). The email went to his spam folder but he happened to check it that day and responded back to me immediately! This was after 10 years of no contact and almost 21 years of not seeing each other after we first met.

11/08-5/09: We traveled back and forth to visit each other. Love at first (second?) sight!

7/09: Married in Helsinki, Finland...after meeting randomly 21 1/2 years ago and finding each other again!!!!!

8/13/09: I-130 sent!!!!!!!!!

If there is no date on the photos (which there shouldn't be) and his appearance hasn't changed, they should be fine. We took a whole bunch of photos at the beginning of the process and used them many months down the line and they accepted them all without incident.

My husband made an appointment with the local immigration office (Boston) before he sent out the I-130 package. At that time (Feb'09) USCIS still requested 4 copies of G-325A. I guess things have changed since May or June'09 and I've been reading on threads they request only one now. To be on the safe side, I'd go to a local immigration office to double check my package with them :thumbs:

As it comes to the photos, they could not know when they were taken, so go ahead and send them... :thumbs:

You're most likely not screwed. VJ's advice is not the end all be all. It's probably safest to send 4 copies, but with only one page posted to the USCIS website, I'm sure you're not the only one who submitted only one copy. Consider even the worst case scenario- they'll just want you to submit three more and that RFE wouldn't cost you more than a couple of days. Don't freak out now!

Thanks everyone.. GOSH this is so confusing. Well, I included four copies to be on the safe side, sent cert mail earlier. Double checked... UGH! Now Im freaking out because I wonder if I should have sent originals of the affidavits showing bona fide marriage - I sent only copies thinking the originals may be needed later on. Hope that doesnt matter too much! I did include a couple photographs.
