I have a quick question that I could not (quickly) find in the more recent posts.

My wife's J-1 expired 8/31 and I know she has 30 days afterward that here visa is still good for. Our AOS packet was received and is currently in the initial review stage and we've recieved our biometrics appointment.

If we wanted to travel within the U.S. via airplane, would anyone stop us at the gates? Since her Visa has expired (I'm assuming they check these things at the gate), I would think they'd question it. During this questioning, is there a document that we can show to prove her "limbo" AOS status? It clearly states that these receipts are not valid for any type of authorization and can not be used to prove her current status.

Has anyone had any trouble with this? Has anyone had any positive experiences with traveling?

(BTW - We did file an authorization for travel, but I'm sure that's just for flights out of the U.S. and it is currently in the initial review stage as well)

She can use her valid foreign passport as photo ID at the airports, and no one should stop you. (If she has a valid U.S. state driver's license or ID card, even better.) Until my wife got her green card, I had her carry the most recent existing paper(s) with her -- first, a copy of my cover-letter that we sent with the AOS filing; then, the NOA1 for the AOS; then, the I-512L (Advance Parole document). Her official status at that time was (and, your wife's now is) "applicant for adjustment" -- or, more concisely, "adjustment applicant." The fact that she has applied for AOS confers legitimacy to her "limbo" status.

If you will be traveling anywhere by car within 100 miles of (especially) the Mexican border, be doubly sure that all of your papers are in order. Customs & Border Protection has internal checkpoints in many locations, and they will demand to know the citizenship status of everyone whom they stop. To their question, crisply reply "U.S. citizen and Adjustment Applicant. Are we free to go?"

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

They generally look at the biographic page, not the visa. Visas often are issued for a year only, but like in case with F-1 visas, you stay legal as long as you maintain your status. My visa expired in January 2009, but my I-94 is valid for duration of status. I travelled by plane in May, and wasn't questioned anything.I think, as long as you carry your I-485 NOA, you shoul be fine FOR DOMESTIC TRAVEL.

2-year green card application:

07/29/2009- Mailed I-130, I-485, I-693, I-864, I-864A, G-325A, I-765 via USPS.

08/02/2009- Package delivered to Chicago.

08/06/2009- Checks cashed.

08/10/2009- Received NOA's for I-485, I-130, I-765 (issued August 6th).

08/19/2009- Recieved Biometrics Appointment notice (bio apt 9/12 at 9am).

08/21/2009- Recieved RFE for I-485 (issued August 17th).

08/22/2009- Responded to RFE.

09/01/2009- Case processing resumed (RFE recieved on 8/27/2009).

09/01/2009- Walk-in biometrics at 1:00pm, in and out in 15mins.

09/09/2009- Recieved e-mail: EAD card production ordered on 09/08/2009.

09/14/2009- Recieved another e-mail: EAD card production ordered (AGAIN!) on 09/11/2009.

09/16/2009- EAD recieved in the mail.

09/21/2009- Applied for a SSN.

09/30/2009- Recieved SSC.

10/14/2009- Received interview notice (Interview on 11/16 at 9:35am)

11/16/2009- Interview,APPROVED and CARD production ordered e-mail!Yay!

11/19/2009- Welcome Notice Recieved and Card production ordered e-mail again!

11/27/2009- Received green card in the mail!

Removal of Conditions:

09/09/2011- Sent the package via Priority mail, with delivery confirmation.

09/12/2011- Package delivered.

09/13/2011- Check cashed.

09/14/2011- NOA issued and received on 09/17/2011.

09/15/2011- Biometrics appointment issued for 10/05

11/21/2011- Card production ordered.

I always show my driver license at the air port. It's easy and nobody question anything. If you have one you good to go.

Oh my gosh! Thanks for all the positive feedback. We're really excited about this! We're hoping to go to New York before the end of the year. Hopefully by then everything will be in order and we can travel without having to worry about status. :)
