Hi, my i-94 is expiring soon and I still havent sent off my AOS forms. I am waiting on tax forms for the affidavit of support.

If my i-94 expires before I send the forms off, what will happen? I have heard that I have until 180 days of arriving in country to submit for AOS.

Where did you hear that? It has no basis.

Apply as soon as possible.

You will accrue out of status days from the time the I-94 expires until your AOS application is received which will be forgiven no matter how many days you accrue upon approval of the AOS.

This could become an issue if you need to travel outside the U.S. or want to work. Not even AP can save you from an entry denial and ban if you accrue too many out of status days.

There is no actual time limit on filing AOS.... but once your I-94 has expired you are out of status until you file for AOS.... if your out of status reaches 180 days then it triggers a 3 year ban on re-entry... so even with AP you would be denied...

There are many people here who have filed for AOS a few weeks after the I-94 expired and they have had no problems....

By the way, we filed the AOS without 2005 returns and just brought them to the interview.

If they really want them before the interview, the could always send an RFE. Even with an RFE, you would not have accrued out of status days as they stop with the receipt of the application.

thanks a lot for the advice. So as long as I file within 180 days I wont trigger the 3 year ban? If i file say a week after it expires, am i right in thinking I wont cause any problems?...

I would send it in now and explain in the cover letter that you will bring the 2005 tax records to the interview.

My husband's I-94 expired back in October 2005.

We're going through the AOS process now.

I'm not too worried. Since yours hasn't expired as of yet, you shouldn't be too anxious. Like everyone else said, it'll be fine~

Timeline:

March 22, 2005 - Sent in Petition for Fiance Visa (i-129f)

March 29, 2005 - Had to resend petition (insufficient stamps)

April 8, 2005 - Attempt #3 sending Petition (is there an unknown conspiracy against me? i put $3 worth of stamps and it's returned to me)

April 21, 2005 - Received Receipt for k-1 visa (NOA #1) receipt was dated 4/11/2005

May 2, 2005 - Received NOA #2 (finally these people are getting their act together)

May 12, 2005 - Found out that NVC sent in my petition and all that good stuff to Korea on May 4, 2005 (i can't express into words how happy i am)

June 16, 2005 - Looked up our case number online to check our interview date..and our number was there!!!

Our case interview will be on July 14th 2005!!!

July 14, 2005 - Interview. and it was a....SUCCESS!!!!!

July 21, 2005 - My fiance and I are in the US of A FINALLY!! We have 90 days to get married.

September 21, 2005 - Coincidentally, we got married exactly 2 months after.

September 23, 2005 - Starting the Adjustment of Status and EAD process.

As long as you got married before the 90 days period, you should be OK. That is the only condition on the K1 visa. You can apply for AOS later, but it has to be before 180 days after your I-94 expired.

A couple of weeks wont hurt you...

from someone with experience try and get the AOS in as soon as possible. I filed our AOS 10 adys after my I94 expired. All well and good, did receive an interview date. However, because of my situation my ex wouldn't go to the interview. I was therefore put in to removal hearing and they backdated my overstay to the expirary date of my I 94. If my AOS had been timely filed ie within the 90 days even tho I was denied then I wouldn't have accumulated so much out of status time. I'm not saying anything will go wrong. Mine was unusual due to abuse etc. But it something that I learnt and thise 10 days caused an extra 10 months overstay.

My advice get it in asap.

My I-94 expired in September and we filed for AOS in November. I got my greencard 2 weeks ago without a problem. As long as you get married within the 90 days you shouldn't have a problem
