What visa does my wife get when she gets a K3 visa?

Hello members,

Newbie question. I recently applied for IR-1/CR-1 via the I-130 application to the Texas Service Center. My understanding is that when this application is approved, my wife would be able to come to the US on a conditional Greencard (Permanent Resident) which is valid for 2 years.

Now if I also apply for the K3 visa via the I-129F application, and this is approved before the I-130 above, what visa status does my wife come to the US with??? I guess the only pro about the K3 is that is can be a little quicker than the IR-1/CR-1. What are the drawbacks of K3 versus the IR-1/CR-1?

Shed some light please.

K3

no automatic greencard

If she wants to work while here with K3, she'll need to apply for employment authorization.

You have to option to apply for Adjustment of status in the U.S. or continue with the IR1/CR1 which would require her to travel back to her home country for the immigrant visa interview.

crifever,

Neither I-130 nor I-129f are visa applications - they are petitions to qualify a person to make a visa application.

As to the question in your subject line, "What visa does my wife get whe she gets a K3 visa?" - she gets a K3 visa. It's a non-immigrant visa, no green card (no LPR status), whereas a CR1 or IR1 is an immigrant visa that begets LPR status upon entry to the USA.
