My wife moved to the US on a K3 visa, after her arrival things got worse in our relationship as I was hoping they would get better. I thought maybe things were not working as well as expected from the long distance relationship.

While she was living in her home country for nearly two years after our marriage, I helped her with her living expenses and thought when she gets here she would help all she could to pay down some debt I incurred because of this and work toward a loving relationship and partnership. This isnt happening, she cares only for herself and what she wants. Of course that is my side of the story, she has hers as well of which we only disagree. I suspect that some people that only see the US through television programs think that life here is fabulous and you do not have to worry about the basic things in life. It's all beaches and Starbucks and having the easy life!

Here is my dilemma:

She wants a divorce. California divorces take 6 months from the time of filing, we have not filed.

I am responsible for her financial welfare for 10 years.

We have bought a second home together, the first one was mine before marriage.

The I-751 has not been filed yet, but must be within 100 days.

I'm not trying to be vindictive, but merely wanting to watch out for myself and not be a bank to her.

What happens if I do not file the I-751 on her behalf? Can I have her removed from the states so that I am not liable for her anymore?

If you /she doesn't file the I-751 by the expiration date she will be out of status and USCIS will start removal proceedings.

You are only financially responsible if she goes on welfare.

She can file on her own to remove conditions.

You can't "have her removed."

You just have to file for divorce and move on with life.

Actually he can "cause" her to be removed if she isn't aware she has to remove conditions. Just don't tell her.

There is nothing you can do to remove her. She can file divorce on her own, she can find all the information that's necessary needed for a waiver with or without her husbands knowledge. Do not assume she is ignorant to this extent. Even the ignorant get well informed by highly skilled lawyers.

OP -- move on with your life by setting her free.
