Hello everyone.

I've looked for this topic but haven't seen it anywhere, so I thought I'd throw it out there. Apologies if it's been covered before.

My wife and I are living in Korea (I'm American) and are about to start the CR-1 visa process. We will move to the States after it's approved. Ideally I'll have a job lined up before arrival, but even if I don't we plan to go.

My question is this: Given the current state of the economy in the U.S., if it proves difficult to find adequate employment after, say, a month or two, could we - after receiving my wife's conditional green card - return to live and work in Korea for a year or so without jeopardizing her U.S. immigrant status?

Married in July 2008. Submitted I-130 to U.S. Embassy in Seoul in October 2009.

Hello,

I think your wife has to apply for a reentry permit.

"Lawful permanent residents and conditional residents require reentry permits to re-enter the U.S. after travel of one year or more."

10/02/2009 - sent DS 230 package from Germany to NVC by UPS

10/05/2009 - NVC received DS 230 package

10/06/2009 - DS 230 entered into NVC system

10/09/2009 - sent AOS forms to NVC by USPS express

10/13/2009 - NVC received AOS forms

10/15/2009 - NVC entered AOS forms into their system

10/19/2009 - case complete (49 days)

10/27/2009 - medical exam

10/29/2009 - got notification regarding my interview date

11/03/2009 - got result of my medical exam (everything is ok)

11/03/2009 - case forwarded to embassy

11/05/2009 - case received by embassy

12/21/2009 - interview date (7:30am - 9:15am - approved) - visa in mail on 12/24/2009

You need to be careful with that,,, If you are out more then 6 months,, you could be classified as abandoning your immigration. At that point you would need to reapply for immigration. I have a friend,,, USC and wife Filipino,, she had done everything for naturalization except the final paperwork/ceremony... They moved back to the Philippines for a year... She lost her status. Now they will have to apply for an IR1 for her to return.
