Do i need to adopt bring my stepdaughter to the US with my last name?

Well, we're in the process in taking away my stepdaughter's father parental rights away. He does not care about her and never gave my wife a cent or cared if they ate. My wife would like her daughter to use my last name, her daughter would also like to have the same last name as her sister. Would i need to adopt her to legally use my last name on her application for a visa? In Bolivia, our lawyer said all i need to do is recognize her as my daughter, after the judge legally removes the father's last name from ym stepdaughter. The goverment would even issue us a new birth certificate with her new last name. Now, could i use that birth certificate, and documents showing the father gave up his last name to get my stepdaughter visa with my last name? Or would i need to go the whole 9 yards and adopt her?

It looks as if you are taking all the right steps. This is an issue for your local family court and perhaps child protective services (department of social services). Each state handles these things differently. Since you are not the birth father, I assume you'll need to adopt. Changing the original birth certificate would not be done in the U.S., but when a baby is adopted right from birth it is issued in the adoptive parents' names.
