Hi! We just found out after deriving my husband's employment income this year, he doesnt meet the income requirement.. it's like $1,000 short when compared to 2009 Poverty Guidelines.. My question is, do we need a joint sponsor? We are living dependently, so there's no one in the household who can help us but his father living in the same town, can he be our joint sponsor? Or my husband just need to fill-up the I-864 even if it's $1,000 short? Will his Income tax returns for the past 3 years will help to meet and establish his ability to maintain suffcient income? beacuse his last 3 years ITR over-exceeds the Poverty Guidelines. In short, even if he doesnt meet the income requirement after deriving his employment income this year, are they going to based that in his ITR for the last 3 years? Any answers will be appreciated.. We are running out of time.. and we wanted to submit the AOS. Thanks again. Edited by Mike and Karol

If his annualized income for 2009 (meaning what he will earn for the entire year, not just up to this point) does not meet the requirements then you will need a co-sponsor. A co-sponsor can be any USC or LPR, not only a household or family member.

Yes, he will need to complete the I-864 as he will always be the primary sponsor.

Your husband could use assets in place of a co-sponsor. The assets would need to be 5 times the amount his income is short, so 5

* 1,000 = 5,000. A savings account, 401k, insurance policy valued at 5k cash, or a house that is valued at 5,000 more than the current mortgage, etc can be used.

And yes, his Father can be a co-sponsor.

you could have his dad as his co-sponsor. it isn't really necessary that you live in the same house.

if his dad is listed in his income tax return, use I-864a..

if not, use the I-864...

both of them needs to fill it up..

Correct. He needs only about $3000 in assets to qualify. As Anh Map said above, be sure he is counting his current annual income, NOT what he has made "year to date"
