(F) Esalaam and Hello to everyone here... (F)

OK hope everyone is doing well, not going too crazy with all the confusion with this immigration process and daily life.

:help: To get to my question's point... I have been told by many wonderful sisters here in my sistuation i should apply for the k3, not the k1....well my question is....has anyone here applied for the k3, as it seems i read everyone's profile, its says k1....i just wanna know what to except...what proves are needed (the same as k1 or?) the wait time about, as i know its longer....and what actually happens when the get the visa and they arrive here? Sooo sorry for my ignorance....but thanx for the helps everyone :help:

K-1 is a fiance visa. The K-3 is for people who are already married.

In order to apply for K-3, you'll need to submit an I-130 first. With it, you need to submit a copy of your marriage certificate. When you get your NOA1 for the I-130, then you submit the I-129F.

Are you already married to your SO? Sorry if I sound stupid for aksing this question, but in order to file for the K-3 Visa, you must first be legally married to your SO.

No mary we are not married, yet....thats what we are trying to figure out...which is the best way....as i am not a USA citizen (yet)...many have told me the k3 is better for me, as i have to wait anyways...but im not sure...just trying to get a idea of what to except...to know which is better?

Henia, you should read the Guides, and Visa FAQ's to get a good idea of what each visa entails. They all have advantages and disadvantages.

A K-1 will be faster however when your fiance gets here he will have to Adjust his status before he can work. He can work for the first 90 days then will have to stop before he adjusts.

I am not sure exactly about the difference between a K-3 and CR1 but I know that a CR1 gets a greencard upon arrival and can work right away.

We chose a K-1 because we wanted to move fast and also because Hicham would not be able to work right away as he doesn't speak English and that is his first priority when he gets here.

Make sure you do lots of research before you choose, and choose the one that is best for you and like I said each one has its benefits.

I forgot to add that there are also several more personal factors that you should consider before choosing such as whether you want to get married in your fiance's country with his family there or if you prefer to get married here etc.

Sarah brought up several good points but I would like to clarify. With a K-1, he can work here for the first 90 days IF he flys in through JFK. However, you don't have to wait until he adjusts for him to resume working. You can apply for a work permit and he can resume working (or begin) when the work permit arrives. Work permits are generally processed within 90 days and can be applied for after you marry and at the time you filed to adjust his status.

The K3 is basically the same as a K1 except you don't have to adjust within 90 days and he can travel without first obtaining Advanced Parole.

Sarah also mentioned evaluating personal reasons. Time is not the only factor to be considered.

Henia, just my opinion mind you, but I would have rather filed for the k 1 since it is so much faster. At the time we decided (DEC 03) the k 3 was relativly new and the approvals were going quite fast. Then they started slowing down quite a bit.

It did not matter where we were married, we just wanted to be together. It depends what you want...to be married (with a longer waiting period) vs fiancee (with a shorter waiting period). You don't even have to file the k 3 since the I-130's were moving quite faster than k 3's.

I filed the I-130 in June 04 and then the k 3 right after I received the NOA. We received notice in Jan 05 that our k 3 was approved. Our interview was sheduled March 05.

I am not sure that helps with the timeline question as ours was so long ago.
