Hello everyone,

I just had my AOS interview yesterday and got the I-551 stamp right away (feeling extremely lucky). My husband's company recently decided to send him to a European local office. He will still be compensated by the US office and the revenue he generates goes directly to the US office as well. I remember reading in the N-400 guideline that if the citizen spouse is engaging in activities that "further the American trade", then the non-citizen spouse won't need to meet the 3-years continuous residence requirement to apply for citizenship. Does anyone have any experience in this regard? Or a good attorney to recommend? Thanks so much!

Hi, I just applied for naturalization according this section of the 319 b of the INA. My husband is a contractor for the govenment in Qatar. It looks like you will fall under the same section. The information about this expeditious naturalization is scarce so you might want to include as much info as you can. I sent the papers on the 1st of September, they received on the 3rd, on the 9th I received the NOA and the fingerprinting appointment paper yesterday, sept 17th. I included a notarized letter addressed to the USCIS explaining why I was applying for the expeditious process and choosing the uscis in texas to process the request, a letter from the company my husband works for, the contract, passport pics (not sure if they needed that but sent anyways) in addition to the regular documents requested. I also sent a certified check from the bank instead of my regular check to make it even faster. Regular checks takes days to clear as opposed to a certified check that is money per se. They also ask for you to identify your packet as a "Expeditious Naturalization" so it will not go with the rest of the others. Things seem to be running fast an smoothly to me. But you have to have in mind that the expeditious naturalization does not mean your process will run fast, just that the 3 year requirement to apply for the naturalization will be waived. Now, depending on the Lockbox you send your papers to as well as your local uscis office, the process might be really fast or take longer. Offices in certain places such as Fairfax, VA has a team especialized in this type of naturalization, so everything is really fast and chances are that you might do the oath part in the same day if you get approved. On the other hand, if you fall under an office that does not deal with this expedited naturalization, your process might take as long as the rest of others.

I hope this info helps. If you send me a pvt message I can send you a copy of my letter to them.

Requirements for naturalization under section 319 b of the INA:

• You must be a lawful permanent resident at the time of your interview.

• You must meet the applicable naturalization requirements outlined in sections 312 and 316 of the INA and Title 8, Code of Federal Regulations (physical presence is not required).

• You must be married to a U.S. citizen and living together in a valid marital union.

• Your U.S. citizen spouse must be “regularly stationed abroad” as:

o A member of the U.S. Armed Forces;

o An employee or an individual under contract to the U.S. government;

o An employee of an American institution of research recognized as such by the Attorney General;

o An employee of an American-owned firm or corporation engaged in the development of foreign trade and commerce for the United States;

o An employee of a public international organization of which the United States is a member by law or treaty; or

o A person who performs ministerial or priestly functions for a religious denomination or an interdenominational organization with a valid presence in the United States.

• You must show evidence that you will depart to join your U.S. citizen spouse within 45 days of your naturalization.
