My husband and I were just hired and I was trying to fill out his w4 form for our new employer but I am a bit stumped.

There is a short spot stating that Nonresident aliens must file a different : form 8233

My husbands still waiting for his green card so I dont know what he is considered... plus reading the form 8233 was even more confusing.

Has anyone gone through this and can tell me what forms i need to fill out?

Thanks in advance for your help :star:

Does he have an EAD? If he has no EAD or green card, he is not eligible to work. K-1 is not a work visa and any stamp given at POE is worhtless without an EAD or green card.

That said, he is a resident.
