Let me first start off by saying I am months away from even thinking about filing for a Visa, but my dad used to say "better safe than sorry", so i want to start getting my ducks in a row. I just have 2 quick questions.

#1 Is it easier to marry in the foreign country and then go for a K3 Visa or just wait to marry and go with the K1?

#2 Will saved instant messages from YM be proof of an on going relationship? I have been saving every chat session but if they will not be benificial then i will go ahead and quit saving them.

The K-1 is fastest. All visas are easy if you have a good case and a real relationship and don't mess up the paperwork.

Yes, they are part of the story you try to tell of your loving relationship.

emails will also do, after we filed for the K-1 we started emailing each other once a week, an email every week for at least 8 weeks can prove an ongoing relationship :)

during the initial phase of the process, we sent in about 6 emails from myspace, facebook, and even a copy of both our myspace page showing each other's comments :)

11/09/09 - AOS

My Dad used t say "There is nothing a man cannot fix, with $700 or a .30-06" Inflation has gotten the better of that saying.

1. There is not one which is "easier" They have different uses. A K-1 is single entry and you must get married in 90 days. You cannot leave or work until you have done the AOS, gotten an EAD or AP. K-3 is multiple entry, and still need to process AOS before working. NEITHER is an immigrant OR work visa. BOTH require AOS. Cr-1 IS a an immigrant visa, requires no AOS and allows work and travel immediately. Your logical choice is between K-1 and CR-1. If you want her to be able to work and travel right away, CR-1 is the route to go. CR-1 requires you be married FIRST, then file.

2. Yes it is proof. Hopefully ou will have LOTS of other things to add to this and not just have chat logs.

1. K1 is a bit faster. Forget the K3, if you do marry go for the CR-1, which emans immediate green card upon entry to the USA, and is also cheaper. Neither K1 nor K3/ CR-1 are easier than the other when it comes to paperwork and getting approved.

2. Chat logs are good. Also keep email, phone bills, and sending a few cards/ letters to eachother snail mail is good too.

i will definitly have more proof than just chat logs. i just wanted to see if they were of use to me. she and i chat everyday for hours and i have already been saving them so i figured that i would put them to good use if they would be acceptable.

new question. i dont know how she does it but she calls me from what appears to be a US phone number. we have talked several times on the phone but if i were to submit records from my cell phone is there any way to show that the calls originated from the Philippines, or is this just a waste of time?

Is it always the same number? If so, then it may be possible to use the phone records as evidence. She's probably using a Voice over IP service (internet telephone). You just need to provide evidence that the phone number is hers.

I gave my fiancee a MagicJack - a little box that plugs into the USB port on a computer, and has a modular telephone jack on the back. Before I sent it to her, I connected it to my computer and activated the account with a phone number in my area code. My fiancee can now call me from her laptop for free. She can also call anywhere in the US and Canada for free. The service only costs $20 per year.

When selecting a visa, you need to rank your priorities:

Is your overriding priority to be together ASAP? (Then do K1)

Is your overriding priority/limitation to save money? (Then do CR-1)

Is your overriding priority to have a big fancy wedding in the Philippines where her family can see/participate? (Then do CR-1)

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

Better to do a K-1 so you get married here in America and it keeps the marriage off the books in the Philippines so when you divorce (ya never know), she doesn't have to worry about annulment in the Philippines (it is a long process).

Also, you have to be in the Philippines for 3 weeks to get married there. The paperwork takes awhile to process. You'll have to go the the US Embassy in Manila to get permission to married too or clearance to married (I forget the details).

Just a quick note of clarification: you can't just file for a K-3. You file for a K-3 after filing an I-130 for the IR-1/CR-1.

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

Our timeline:

2/88: We met in Sydney, Australia at a youth hostel! He's Finnish, I'm American-both were in our early 20s at the time and fresh out of college (so couldn't afford to visit each other's countries after that!). We had a three-day romance, then went our separate ways. He actually was going to Sydney a week later, but decided at the last minute to cut his trip short in another country and go early. Wow.

1988-1998: Wrote "snail mail" letters/sent Xmas cards, but lived our separate lives. I married someone else, divorced in 2006...he lived with someone for years and then that ended.

10/08: Because of a series of random life events, I Googled my Finn Man and found him (but no link to his email, and the website his name was on was in Estonian so I couldn't even read it!). It took me two weeks to find a link to someone else, who forwarded my email to him (we were both single at the time thankfully!!!!). The email went to his spam folder but he happened to check it that day and responded back to me immediately! This was after 10 years of no contact and almost 21 years of not seeing each other after we first met.

11/08-5/09: We traveled back and forth to visit each other. Love at first (second?) sight!

7/09: Married in Helsinki, Finland...after meeting randomly 21 1/2 years ago and finding each other again!!!!!

8/13/09: I-130 sent!!!!!!!!!
