I actually have a question here and whoever knows any information, please share.... Is Financial Aid is considered Public Charge? you know that spouse who comes to the US through a CR1/IR1 visa process shall not be a public charge... but what if he wanted to enroll in school, is he/she can be eligible for Financial Aid?

The DOJ proposes to define public charge to mean an alien who has become (for purposes of deportation) or is likely to become (for purposes of admissibility or adjustment) "primarily dependent on the Government for subsistence, as demonstrated by either the receipt of public cash assistance for income maintenance or institutionalization for long-term care at Government expense."

Cash benefits for income maintenance include the following: (1) Supplemental Security Income (SSI); (2) Temporary Assistance for Needy Families (TANF), but not including supplemental cash benefits excluded from the term "assistance" under TANF program rules or any non-cash benefits and services provided by the TANF program; (3) State and local cash benefit programs that are for the purpose of income maintenance (often called "General Assistance" but which may exist under other names).

So it seems that Student financial aid is not considered "public charge" Although I probably would not bring up this intention with the officers???

4/4/2013. : Oath! Now a U.S. citizen!

Cool, but what are these acronyms stand for? LPR = Lawful Permanent Resident... CLPR = Conditional Lawful Permanent Resident ... did I get it right?

Sounds right, but I dunno the acronyms, but I happen to see the above definition on one of the websites I was on earlier... Hope it helps...

I believe food stamps, energy assistance and child care assistance are also considered public charge.
