Hi again everyone!!

I am applying for Adjustment of Status (got married in the U.S in August), and I am putting this in the mail tomorrow and wanted to make sure I have everything in order so I don't get any RFE's. I have the checklist in front of me, but have some questions:

-Coverletters: Is it ok if I (the immigrant and husband) sign the coverletters, or does my wife (the U.S citizen) have to sign also? She's out of town for a week, that's why I ask.

-Form G325A: The checklist (nr 14) tells us to attach 1 passport photo of foreign spouse (me, the husband). But then it says to write the full name of beneficiary on the back. Who is the beneficiary??

-Form I-485: Which box do I check in Part 2? The form asks why I am applying for adjustment of status. I am thinking it's gotta be either one of the following two:

A) An immigrant petition giving me immediately available immigrant visa number that has been approved, or a special immigrant visa petition filed with this application that will give you an immediate available visa number, if approved.

H) Other basis of elegibility. If so, explain.

I am in the U.S on an F-1 VISA currently on OPT. My work permit expires in December. So which one do you guys think I should check??

Yes, it is your application so it is fine if only your signature is on the cover letter

You are the beneficiary - the foreign spouse is the beneficiary.

A) An immigrant petition giving me immediately available immigrant visa number that has been approved, or a special immigrant visa petition filed with this application that will give you an immediate available visa number, if approved.

You are adjusting status based on your marriage to a US citizen so it would be A). An immigrant petition is the I-130 that you are submitting at the same time, which will provide for an immediately available immigrant visa number once it is approved. You file both of the forms together and the I-130 is approved and then they look at the I-485.

Hi,

I am in a similar situation where my husband is a US citizen and I am a student on F-1 visa. For Form I-485 question 2 why is option b not appropriate for my case "My spouse or parent applied for adj of status or was granted lawful permamnet residence in an immigrant visa category that allows derivative status for spouses and children".

It might be the right box to check in your case. I married a U.S born citizen. Was your husband born overseas? If so, your case might be different from what I understand. But again, I'm not an expert. Try posting your question in your own thread and give some more details about your case and I am sure someone will be able to tell you what to do.

Read and understand the difference between the two choices. A & B

Choice A - means that a US Citizen spouse is petitioning you and you're are now applying for an adjustment of status. You dont have to wait for the immigrant visa number since once filed as a spouse you will immediately receive an immigrant visa number.

Choice B - means your spouse or your parent applied for an adjustment of status wherein you are also part of the adjustment processing. it shows that the spouse or parent is also a nonimmigrant and now applying for an AOS/I-485

Im also on a F1 visa and married to a US citizen. Im now filing for I-485 and i chose Choice A for that.
