Having children after marriage?

Hi there,

I am just wondering about what the situation would be about having children after marriage and before the AOS process is complete? Obviously the child born would be an american citizen automatically but would it effect my application and where would that come into play, if at all, on the forms from AOS right up until becoming a US citizen?

Just wondering... Im not pregnant or anything, but would just like to know...

Just make sure you have insurance that covers pregnancy, I know mine won't cover me for the first 12 months and i'm not eligible for medicaid!

It will help a bit with AOS because it goes towards the bonafide marriage part, though it will also make it more difficult as your household size for the affidavit of support will be bigger, this you/ your husband have to make more money.

No bearing on immigration, as far as I know, unless they ask you to update your I864 and you no longer have income to cover the added person in the household...but hopefully you work out those finances before getting that way. :)

Good point about insurance, and make note of when you are covered, so they cannot say you had a pre-existing clame.

Kinda funny to read the topic of this thread, as if having a child after marriage is now unusual. :jest:

At my interview aos, after the approval the officer said that if we have children by the time of removal of conditions ( we don't yet) that we should bring their birthcertificates as proof/evidence to our removal of conditions interview. I am guessing it's evidence of a bonafide marriage, and would be the same aos so if baby born by then don't forget the certificate. :)

It will help a bit with AOS because it goes towards the bonafide marriage part, though it will also make it more difficult as your household size for the affidavit of support will be bigger, this you/ your husband have to make more money.

Sorry to jump in here...I am pregnant and due March 2010. My husband and I are still deciding which way to file...wait 3 more months and do DCF or me move back now to the states and go CR-1 route. If doing the DCF route, my mom was going to sponsor my husband...does this mean she will have to make more than 2 times the amount with having a child (USC/UKC)? If going the CR-1 route, will I have to make 2 times or 3 times the amount? I have worked non-stop for 16 years and have just been unemployed for the 3 months living in the UK, and I could return to my old company or a competitor in the same field. I am just trying to get all of our ducks in a row to see which way will be the best way for us to go.

Thanks =)

If I could have done DCF, I would have. Being apart is so difficult! DCF is so fast, he'd probably get to the US sooner even with the 3 month wait.

It's not 2x the limit - in fact, since the child isn't going to be claimed on anyone's taxes as a dependent when you file (in Dec, still 3 months to go, probably still not born yet when you interview), your child probably won't count towards the household size at all. Check the poverty guidelines - there are different numbers for different household sizes, and I don't believe it's a strict multiplication.

I'm not sure about DCF or CR-1 but if you need to file the I-864 with this then here are the poverty guidelines for 2009 but they will go up in 2010:

Thank you all for your feedback! I think we are going to go CR-1 route due to the delay with having to wait for the baby's US passport after the approval via DCF since I wouldn't be eligible to apply DCF route until December and baby is due in March. Plus...hubby doesn't want to live with the mother-in-law...lol!

Thanks again!!!
