Hi guys

My wife and I are about to tackle the AOS process. I'm on a K1 visa. We are just hesitating on a small question on the affidavit. My wife needs to prove that she can support me.Will have to do that on the basis of her last year's income (2005)? Or on the basis of this year's income (2006) or on the basis of the year to come (2007). Besides, she just got a new job, but she hasn't started yet. Will she have to show the amount of money her future boss will pay?

Hello,

I am also preparing to file for AOS from what I understand the rules are changing as of July 21st for the I-865. From what I read you just have to include the 2005 tax return now. Here is the link:

I need a co sponsor too so I think we will just be submitting my husbands 2005 tax return, my mother in laws 2005 tax return and her W-2 (she filled joint income with spouse). We will then continue to collect pay stubs and employee letters in case they are asked for later at the interview or in RFE.

If you want to be on the safe side you could send the 2005 tax return, a letter from the bank stating your balance and how long you have been there and a letter from your wifes future employer stating her salary, position and start date.
