i need all the answers i can get !!! for my domicile issues, would it be good to send in my credit cards and have my parents send me some mail in get back in the USA with my name on it? is being a joint in a bank account good enough? because i am not there to open my own bank account and no one can do it for me... please any tips would be greatly appreciated ! i cant sleep !!! i lost 6 pounds so far, maybe thats the only thing coming out of this whole process !

Do you actually have a domicile in the US? Or, do you just have credit cards, and use somebody elses mailing address? If you returned to the US today, where would you live? Would one of your relatives have to put you up?

In order to sponsor an immigrant, you must have a principal residence in the US, and intend to maintain that residence for the foreseeable future. Proof includes your name on a deed or lease, utility bills in your name, children registered in local schools, or other proof that you are living abroad temporarily. If you gave up your residence in the US when you went abroad, then you need to re-establish domicile in the US before the visa will be issued. Otherwise, your affidavit of support is worthless and unenforceable. You can re-establish domicile by returning to the US and renting an apartment.

i didn't give up my residence in the USA. And yes, i do actually have a domicile in the USA. i don't appreciate the tone i am sensing from you, please keep from judging me,otherwise, don't comment at all. I know my post might have sounded desperate, but that is exactly how i feel right now and i DON'T need you judging me. the USA is where i plan to live (God willing) and i am only here temporarily because i cant stand the fact of being away from my husband for even one day! I am planning to stay with my parents until we get on our feet, and that is the same address i provided the NVC and USCIS.I am not on their utility bills. Again, if you don't have any helpful suggestions and friendly ways to post them, please keep away. You will relive me of some extra stress !

thank you, seriously your words mean a lot to me. I guess i should not rely and try to find support online, but me and my husband are so stressed and i figured people here are going through the same thing we are going through. Neways i will take your advice!

Just for the record, and emphasizing my concern for your situation: The "critical poster" of above is (in my firm opinion) one of the VERY most sensible and level-headed members of VJ. Folks can rarely go wrong by following his advice.

It's tough to be under stress and to receive blunt-sounding advice over the Internet. We are all at a disadvantage because we can't hear a tone of voice or perceive body language. When in doubt about a poster's tone, I picture the person placing his arm around someone in a kindly way and giving advice with the best of intentions. If that method softens my perception of his tone, there's my answer; if it doesn't, that's another matter altogether. But it usually does soften my perception.

Oh, and OP... please create your VJ timeline.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

My thoughts exactly! I personally didn't read ANY judgemental or critical tone in Jim's post. But I can most certainly say that judgemental and critical responses to someone trying to help, will generally lead to people not wanting to give advice.

Best to go to the US a get a bank acount, place to stay with telephone. Lackof proof of domicile is one of the main reasons people are dened.

At least in the Philippines.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

JimVaPhuong offered sound, non-judgemental advice. He asked a very important questions which you haven't answered. If you were to move back to the US TODAY, where would you live? If you have an apartment or home already then you can use the lease or mortgage for that to show domicile. If you are to live with your parents, you can have them write a letter explaining that you intend to move in with them for X amount of dollars per month until you find a place of your own.

just chiming in. jim's post was very accurate. he is a well-informed poster.

oh, you can also get a bank account online. even through bank of america. that is what i did, and i live in the usa. you can transfer money required to open from another bank account or a credit card. or you can have your parents deposit and open an account in your name.

and i like the advice about placing the arm around someone, i will use it next time i feel offended or as if i am being judged.

you don't know what i appear to want to hear, the first 2 lines in his post seemed judgmental to me. I am not looking for anything out of the ordinary, i just asked some questions wondering if my credit cards would also help.

thank you. but i DID answer the questions before, i said that the NVC and USCIS both know i will reside with my parents until we get on our feet. THAT is the address i get my mail at, its not some other persons address as he made it seem like in his first 2 lines. as if i am only USING that address to get what i need. that IS my address and my home ! thank you again though

If you returned to the US today, where would you live?" is the part that sounded judgemnetal to me. as if i am only USING someone eleses address. neway i am not here to cause stress of annoyance, nor to fight. so thank u for your post
