When does the ban for overstay Start

My wife has an approved K3 and she will have her interview soon, she overstayed less than 12 months and more than 6 months, she departed usa on 2nd feb in 2007 so i am trying to see when her ban ends. when does the ban start

Has she obtained a waiver?

The ban started when she left the US (assuming she was over the age of 18 when she overstayed)

So, if she left on February 2nd 2007 then her ban will be lifted February 2, 2010. They seem to be pretty firm on this so unless she interviews February 2, 2010 or later, she will be denied her visa at the interview.

PS - Waivers are obtained after the interview and the I-601 is submitted. Since the OP's wife has not had the interview yet, the waiver has not been obtained.

Three years from the departure date--Feb 2010.

so this will be some more wait, would have liked to have my wife deliver in the usa like the earlier two kids with C Section, kinda sucks but then cant have life my way also
