Hi,

My husband, who's Irish, and I were married in May, in Dublin. We live in Paris, I've been living here for 6 years, he for 2 1/2. We want to move to the US in the beginning of 2010, and have read about applying for his green card first with the I-130, and then once it's been received by the USCIS office, applying for the K3 which should allow him to enter the US while waiting for the I-130 to be processed. However, I'm not sure if I should send in the I-130 to the USCIS office in the states, since technically I'm a US resident, citizen etc...although I am living abroad, or do we have to apply abroad??? I'm afraid applying abroad will make things even more complicated. Has anyone else been in this situation? And has anyone gone through the process of bringing in a spouse on a K3 visa while waiting for the green card app to go through? Any advice?

Thanks so much in advance

Kyla

I am US citizen, married to Pakistani & we are living in Pakistan for last 3 1/2 years. I have applied I-130 at NVC. But I instead of K3, I have applied for permanent residency (IR-1) for my wife through consular processing.

I am dual citizen (Pakistan and USA) and did not have work/resident visa for Pakistan on my USA passport so I was not allowed by US Embassy in Pakistan to applied PR of wife through DCF.
