Timeline

Hello, I really havent used this webpage too much but I am really hoping someone here can help me with my problem. I got married to my wife in June who came here on a k1 visa. Well, her father has gotten deathly ill and she had to return to Japan before her AOS. She got her paper pwork expidited so she could leave the country. Her father actually seems to be pulling through and her return ticket is for Sept 22nd this month. If her father takes a turn for the worse will she be able to go back to Japan considering she has an approved Authorization of Alien parole of Alien into the United States? Please help me out with this because this will change everything if she goes home by Sept 22nd or not. Thanks everyone.

Have you filed the AOS with the AP and was the AP approved already? There should be a date on it that expires

Have you filed the AOS with the AP and was the AP approved already? There should be a date on it that expires

Yes, we filed for the AOS and AP. The AOS interview date is on Oct 16th and the AP was expedited and approved. Does this mean she can come and go from the country as much as she wants as long as its by the experation date on her AP?

Yes. If it's not expired she should be able to still use it. Also she can apply for an extension if she needs it, but it's good for like 12 months. Tell her to check her card.

Timeline

You can also call USCIS to see if it's still valid. It never hurts to call and ask them. I would do that and see what they have to say, but they expedited it because they know about what's going on. They do not expedite it without medical documentation saying that have to go back for an emergency. You supplied this right?

OK, thank you. The only thing is that she did not get a card, she got one of the papers with her picture on it. it was a I-512L, is this the same thing?

Also, you do not need an AP if you still have a valid visa. If her K-1 visa is still valid she can travel with that. The AP is only for the time between when your visa is expired and when you get your residence card from the AOS or if you are going to be traveling outside the states for over 12 months. I will check my information just to be sure and post again.

Also, you do not need an AP if you still have a valid visa. If her K-1 visa is still valid she can travel with that. The AP is only for the time between when your visa is expired and when you get your residence card from the AOS or if you are going to be traveling outside the states for over 12 months. I will check my information just to be sure and post again.

I really appreciate it rings. We are just worried and we want to make sure she can come back to the states. Her K-1 is expired and we are already married.

2) NO, it should be a general AP for 1 year.

3) Do not bother new application may just confuse the situation.

What type of visa did you enter on? K-1 needs AP K-3 does not. You timeline is not helping.

The AP is only used for the time you do not have a valid visa. If the K1 is expired she can use her AP to go in and out within a 12 month period (until it expires) and this is used when your AOS is pending. You can call USCIS to see if I am correct or not, but I am confident in my answser.
