I'm still confused as to why CR-1 takes longer at the NVC than K3.

Apologises if I'm being stupid

Again, as I said, the documents that you would normally just take to your interview are instead sent to NVC. It is AT MOST a one month delay unless you get an RFE. I would take that one month away from my spouse for a much better visa.

Cr-1 is an immigrant visa, the K-3 is a non-immigrant visa. It takes longer because there is more to process in order for you to enter the US as a legal permanent resident. NVC does that organization and processing.

It's just the way it is. We can ask 'why do they do it this way?" "Why does it take longer' when the only real answer is 'it just is'

As my CR-1 is approved before K3, there no way that they will approve my K3 now?

I know it's a month, but that's still 4 weeks! Right now I'd like to go via K3. If CR-1 is 2weeks longer that's OK, but I want to be in USA before Thanks giving, as that's is a holiday I'd like to spend with my wife. If I get to USA any sooner, like in October, that'll be fantastic.

I hate to be blunt, but there is no damn way you're going to be in the US by October. November? MAYBE.

However, unless your I129F is approved in the next day or two, you have no choice but to pursue the CR1.

I went the K-3 route, because we were married and processing during the 07 tidal wave of applications.

Not an expert...so someone can correct me if I’m wrong….

My understanding CR-1 is best route, to avoid AOS later…etc…. (We are currently going through AOS).

Reason for delays:

When NVC receives I-129f (For K-3/1) approval, they assign number and send to Embassy.

When NVC receives I-130 (CR-1 route) approval, they then process similar to AOS. If not already received, then I-134 / I-864 will be needed and requested of petitioner. FBI checks, etc…

Takes a little longer for CR-1, but has it's advantages....and you may not have the option if I-130 was already approved and forwarded to NVC.

Not likely they will approve the K3, its ither both at once, or just the I-130 or the I-129F

I864 delivered November 2nd.....nvc logged it on November 5th

DS230 delivered November 6th.....nvc logged it on November 12th

Here is why the CR1 takes longer then the K-3:

K-3 NVC process - very limited maybe a basic name check. Then petition is forwarded to embassy - NVC has virtually no work. In addition appointment set by embassy

CR1 NVC process - Upon receipt NVC generates an agent of choice letter - NVC waits till foreign spouse designates the agent (usually petitioner). Next NVC generates the Affidavit of support bill ($70) and the Visa bill ($400) once these bills are paid and updated, then NVC generates a few other documents and waits for petitioner/spouse to submit Affidavit of support and DS230 Visa application. The visa application must have support documents and pictures submitted. Upon receipt of those items the NVC reviews everything - then completes the case (some security checks in there somewhere). Once the case is complete, the NVC issues you an interview date based on criteria from the embassy.

As you can see the CR-1 process has a few steps which involve the NVC waiting for things to be received.

However - it is an immigrant visa so you get social security number and greencard very soon after you enter the usa which allows you to drive, work, etc which cannot be done with a

K-3 until you adjust your status (3+ months wasted time in usa)

Thanks for the feedback everyone. I'm very happy of the approval. it's very difficult staying away from your loved one. Just hope everything is done very fast. We have have a lawyer, we filled in a form and sent this to CSC, to inform them of this and to forward paper to the lawyer. As they already know we have appointed a lawyer, will we still need to fill out DS-3032 form (choice of agent form)?

Malrothien - this forum's purpose is for support from fellow VJ's. Although you might be correct with your assumptions, please bear in mind that your "bluntness" cant be misconstrued. Visa is a sensitive time for couples. You need ot take caution with your wording, as this can be very upsetting for others. Be supportive, give encouragement, but word the negative aspects with respect.

Technically no - but you can send it in anyway. Since you have a lawyer they are automatically your choice of agent.
